This fiber optic indefeasible right of use agreement (“Agreement”) is entered into by and between the Board of County Commissioners of La Plata County, Colorado (“La Plata County”), the Board of County Commissioners of Archuleta County, Colorado (“Archuleta County”), the Southern Ute Indian Tribe (“Tribe”), La Plata Electric Association, Inc. ("LPEA”), and Region 10 League for Economic Assistance and Planning, Inc. (“Region 10”). La Plata County and Archuleta County are referred to collectively as the “County Parties”. The Tribe is referred to as the “IRU Grantor”. The County Parties, LPEA, and Region 10 are referred to collectively as the “IRU Grantees”. The signatories to this Agreement are referred to collectively as the “Parties”, and individually as a “Party”.
