THIS PUBLIC ACCESS AREAS AGREEMENT (this “Agreement”) is made this day of 2003, between DUKE ENERGY CORPORATION, a North Carolina corporation (hereinafter referred to as “Grantor”), and the NORTH CAROLINA WILDLIFE RESOURCES COMMISSION (NCWRC), an Agency of the State of North Carolina (hereinafter referred to as “Grantee”) and which may be referred to individually or collectively as “Party” or “Parties”;
