This SOFTWARE-AS-A-SERVICE (SAAS) USER AGREEMENT (the “Agreement”), dated the first day the software was put in use by requesting the software for trial or other use (the “Effective Date”), is by and between Ondema, Inc., a Delaware corporation (“Provider”) and the requesting entity and end- user of the software (“Customer”) with business information provided during the sign-up process (“Sign- Up”).
