All Tenant’s installations of equipment on the roof and any required interior and/or exterior ducts shall be subject to Landlord’s reasonable approval, and in no event shall such installation exceed the live load, or the Base Building System capacity as allocated to Tenant or University Park design guidelines all as approved by Landlord and permitted under the appropriate building code such approval not to be unreasonably withheld or delayed (collectively, the “Common Areas”).
As used herein, "Base Building System" means any mechanical (including HVAC), electrical, plumbing or fire/life-safety system serving the Building, other than a Supplemental System.
Any such repairs or alterations shall be made at Tenant’s expense (1) by Tenant in compliance with Article 5 if such repairs or alterations are nonstructural and do not affect any Base Building System, or (2) by Landlord if such repairs or alterations are structural or affect any Base Building System.
Tenant shall during the Term maintain at the Building a log of Tenant’s use of any part of the Base Building System during non-Business Hours or on non-Business Days, showing each such use and the length of such use, which log shall be available to Owner for inspection and copying.
Any such repairs or alterations shall be made at Tenant’s expense by Tenant (1) in compliance with Article 5 if such repairs or alterations are nonstructural and do not affect any Base Building System, or (2) by Landlord if such repairs or alterations are structural or affect any Base Building System.

Such costs shall be calculated by Landlord by multiplying the total utility costs for the use of such Base Building System for the Building by a fraction the numerator of which is the tonnage of Tenant’s supplemental HVAC connected to the Base Building System and the denominator of which is five hundred (500) tons, or one thousand (1,000) tons if the second five hundred (500) tons of existing equipment is used for this purpose.
Landlord represents and warrants to Tenant that, as of the date hereof, Landlord has not received written notice from any governmental agency (and Landlord does not otherwise have actual knowledge, without any duty of inquiry) that any portion of any Base Building System located in and serving the Expansion Space (other than in any restroom located in the Expansion Space) violates applicable Law, as determined without regard to any Tenant Improvements (defined in Exhibit B attached hereto) or Alterations.
Any area of the Building or Land which would (but for this Lease) be for the common use of all tenants of the Building, including, without limitation, the lobby, the loading docks, the sidewalks and the Building entrances, the Base Building System mechanical rooms, meter rooms, boiler rooms, fuel oil tanks, utilities and generators.
Tenant shall pay its share of utility costs associated with its use of the Base Building System.
