CEDR Model Mediation Procedure definition

CEDR Model Mediation Procedure means the CEDR Model Mediation Procedure in force at the Commencement Date;
CEDR Model Mediation Procedure means the model mediation procedure edition 9A as adopted by CEDR as of February 2004;
CEDR Model Mediation Procedure means the procedure referred to in Paragraph 10.5 of this Memorandum of Understanding;

  • The mediation may be terminated by any means described in the CEDR Model Mediation Procedure.

  • The Parties must agree on the selection of a mediator or, where agreement cannot be reached, the mediator will be selected in accordance with the CEDR Model Mediation Procedure.

  • Although mediation is a voluntary process, TheFork and the EU Restaurateur both agree to engage in good faith throughout any mediation attempts, and to do so in accordance with the CEDR Model Mediation Procedure.

  • The Mediation Agreement referred to in the CEDR Model Mediation Procedure shall be governed by and construed and take effect in accordance with English law.

  • Subject to clause 13.3, any Dispute which remains unresolved following the exhaustion of the procedure set out in clause 13.1 may be referred to mediation in accordance with the Centre for Dispute Resolution ("CEDR") Model Mediation Procedure ("Model Procedure").
