Closing Date Extension – This addendum is used when both parties agree to extend the closing date.
In order to exercise the Closing Date Extension, ▇▇▇▇▇ shall deliver written notice to Seller prior to 5:00 p.m. Florida time on the Closing Date.
Buyer shall pay to Seller, through Escrow, the sum of Twenty-Five Thousand Dollars ($25,000.00) (an “Extension Fee”) for each Closing Date Extension that Buyer elects to exercise.
If, pursuant to Section 9.5, the Closing Date is extended either in writing by a Closing Date Extension Amendment signed by Seller and Buyer or unilaterally extended by Seller, the term “Closing Date” shall refer to the extended Closing Date.
The Extension Fee shall be due and payable upon Buyer’s delivery of the Closing Date Extension Notice, and Escrow Holder shall promptly disburse any and all Extension Fees to Seller.

Buyer shall send an executed copy of the Closing Date Extension Amendment and a copy of the check for the above- described fees to Seller to the e-mail address or fax number shown in Section 1.2, and shall deliver the signed agreement and the check to the Closing Agent within one (1) business day thereafter.
Any Closing Date Extension Deposit made by ▇▇▇▇▇▇ Homes shall be applicable to the DP Exchange Value and shall be nonrefundable except in the event of the District’s default or termination of the Agreement under Section 2.5. The terms the "Close of Escrow", and/or the "Closing" are used herein to mean the date the Grant Deeds (as the term is defined in Section 3.4 herein) are recorded in the Office of the County Recorder of the County(s) in which the Properties are located.
Buyer’s right to extend the Closing Date shall apply if and only if, at the time Buyer provides the Closing Date Extension Notice, the Authorities have not Approved the Zone Change, Specific Plan Amendment, or Buyer’s Final Map.
The Extension Fee shall be due and payable upon Buyer’s delivery of the Closing Date Extension Notice.
