Commonwealth Data definition

Commonwealth Data means the information created, maintained, or stored by or on behalf of the Commonwealth in whatever form such data is created, maintained, or stored. For purposes of clarification, Commonwealth Data includes Sensitive Information, but may also include information freely available to the public.

Commonwealth Data means all data and information relating to the Customer, any Client, or any Client property the subject of the Services (including personal information), in whatever form that data and information may exist and whenever provided.

Commonwealth Data means data provided by the EOHHS to Harmony, which may physically reside at a Commonwealth or EOHHS or Harmony designated location.

The Licensor shall only host, store or backup Commonwealth Data in physical locations within CONUS.

More Definitions of Commonwealth Data

Commonwealth Data means all data that are: (i) owned or controlled by the Commonwealth and provided to the Vendor by, or on behalf of the Commonwealth, in connection with the Project; (ii) Commonwealth data provided to, received, maintained or accessed by Vendor in connection with this Agreement; (iii) derived or generated by the Vendor in the performance of configuring, testing or data loading, cleansing or conversion activities for the Commonwealth in connection with the Project; (iv) data created by the Commonwealth in its use of the services or the systems provided by the Vendor under the Project, including without limitation, all personal data as defined in M.G.L. Chapter 66A and data referred to in Section 6 of the Commonwealth Terms; (v) Protected Health Information under 45 CFR Parts 160 and Part 164; (vi) “patient identifying information” as defined in 42 CFR Part 2; and/or (vii) any other individually identifiable information that is treated as confidential under any federal or state law or regulation (including, for example, any state and federal tax return information) that the Vendor (or its subcontractor or agent) uses, maintains, discloses, receives, creates or otherwise obtains from the Commonwealth in connection with the Project.

Commonwealth Data means all Data provided by, or collected, processed, or created on behalf of the Commonwealth, unless otherwise indicated in writing.

Commonwealth Data means, in or on any media or form of any kind: (i) data, or summaries or indices of data, related to or describing the Commonwealth or any Eligible Customer, or the residents, constituents, citizens, clients, customers, employees, agents, subcontractors, or other representatives of the same, or related to or describing the Services or the Systems, regardless of whether or not such data, summaries or indices are owned by the Commonwealth or any Eligible Customer, generated or compiled by the Commonwealth or any Eligible Customer, or provided by such residents, constituents, citizens, clients, customers, employees, agents, subcontractors, or representatives, including data that are in the Commonwealth’s or any Eligible Customer’s databases or otherwise in their possession or control on the Effective Date or at any time thereafter; (ii) other Commonwealth or any Eligible Customer records, data, files, input materials, processed data, results of data analyses, information, reports, forms, and other such items and materials that may be created, received, computed, developed, used, or stored by Vendor, or by any of Vendor’s Subcontractors, for or on behalf of the Commonwealth or any Eligible Customer in, or in connection with, the performance of Vendor’s duties under this Agreement, but excluding in any event any internal data and information of Vendor and its Subcontractors (other than service level measurements and contract charges) and any correspondence between the Parties; and (iii) modifications, compilations, and derivative works of the items, data, and other materials described by the foregoing clauses (i) and (ii) as being included within Commonwealth Data.

Commonwealth Data means any data or information, regardless of form or characteristic, including but not limited to information that can be used to distinguish or trace an individual's identity, either alone or when combined with other personal or identifying information that is linked or linkable to a specific individual, collected or obtained by the Contractor pursuant to this MOA.
