Differing Site Conditions definition

Differing Site Conditions means concealed or latent physical conditions or subsurface conditions at the Site that are of an unusual nature, differing materially from the conditions ordinarily encountered and generally recognized in the area of the Site as inherent in the Work.

Differing Site Conditions excludes: (1) conditions of which Contractor had actual or constructive knowledge as of the Effective Date; (2) conditions that should have been discovered through a reasonable site investigation performed in accordance with Section 5.1; (3) Hazardous Substances, including also contaminated soils and groundwater (which Hazardous Substances are governed by Article 9); (4) conditions caused by a Force Majeure Event; and (5) conditions that come into existence after the Effective Date.
