Should Customer request migration of Generated Data to a different Cloud Storage Provider or an on-premises location provided by Customer, AvePoint shall assess whether and to which extent such migration is reasonably possible and such assessment and migration (if any) shall be performed by AvePoint at AvePoint's then current rates for such services.
Except as set out in Section 10.3 (Data Retention and Migration of Generated Data) below, Customer acknowledges that following termination, cancellation, or expiration of this Agreement or any Subscription, it shall have no further access to any Customer Data in the SaaS Solutions, and, except as provided elsewhere in this Agreement, that AvePoint may delete any such data as may have been stored by AvePoint at any time.
Agency understands and acknowledges that Flock has no obligation to monitor or enforce Agency’s intellectual property rights to Agency Generated Data.
Agency shall retain whatever legally cognizable right, title, and interest that Agency has in Agency Generated Data.
In the event Flock is legally compelled to comply with a judicial order, subpoena, or government mandate, to disclose Agency Data or Agency Generated Data, Flock will provide Agency with notice.
