Generator Event of Default definition

Generator Event of Default has the meaning given to it in Section 16.1;
Generator Event of Default has the meaning ascribed to it in Section 11.1. “Generator Indemnitees” has the meaning ascribed to it in Section 16.3(d). “Generator Non-acceptance Notice” has the meaning ascribed to it in Section 14.3(d).

Examples of Generator Event of Default in a sentence

  • No Generator Event of Default will be waived or be deemed to have been waived by any inspection by or on behalf of the AESO.

  • An inspection or audit not followed by a notice of a Generator Event of Default shall not constitute or be deemed to constitute a waiver of any Generator Event of Default, nor shall it constitute or be deemed to constitute an acknowledgement that there has been or will be compliance by the Generator with this Agreement.

  • If termination for Generator Event of Default occurs after commercial operation of the facility, the AESO may exercise all remedies it has at law or equity, including pursuing a claim for damages.

  • The RESA will include a specified methodology for calculating the "mark-to-market" damages in the case of a Generator Event of Default.

  • The Generator shall notify the Counterparty within thirty (30) days of a senior officer of the Generator determining that such inconsistency exists and understanding the implications thereof, provided that the failure to do so shall not constitute a Generator Event of Default.

  • Without prejudice to its ability to assert a claim for Discriminatory Action pursuant to Article 14 or to any right or remedy of the Generator thereunder, the Generator shall notify the Counterparty of any Change of Law or proposed Change of Law of which it becomes aware and that could reasonably be expected to result in a Discriminatory Action; provided that any failure to so notify shall not constitute a Generator Event of Default.

  • If termination for a Generator Event of Default occurs prior to commercial operation of the facility, Generator will pay, as liquidated damages, a sum equal to the Completion and Performance Security (i.e. $50,000 per MW of Contract Capacity) and AESO’s remedies are limited to such amount.

Related to Generator Event of Default

  • Train Operator Event of Default has the meaning ascribed to it in paragraph 1.1 of Schedule 6;

  • Lease Event of Default shall have the meaning specified in Section 17.1 of the Lease.

  • Senior Event of Default means an Event of Default under a Senior Financing Agreement.

  • PTC Event of Default Means any failure to pay within 10 Business Days of the due date thereof: (i) the outstanding Pool Balance on the Final Legal Distribution Date or (ii) interest due on the Certificates on any Distribution Date (unless the Subordination Agent shall have made an Interest Drawing or Drawings (as defined in the Intercreditor Agreement), or a withdrawal or withdrawals pursuant to Section 3.6(f) of the Intercreditor Agreement, with respect thereto in an aggregate amount sufficient to pay such interest and shall have distributed such amount to the Trustee).

  • Potential Event of Default means any event which, with the giving of notice or the lapse of time or both, would constitute an Event of Default.
