The initial regulations, which shall apply until amended in accordance with the Master Declaration of Trust, are set out in schedule 3 to the Master Declaration of Trust.
The Borrower shall maintain wastewater rates and charge fees in connection with the operation of the Facility that are adequate to generate Net Revenues in each fiscal year sufficient to meet the Rate Covenant requirements of the Master Declaration, including taking any required action thereunder if Net Revenues fail to meet the Rate Covenant requirements in any fiscal year.
