Minimum Call-In Time. A unit member required to work on a day when the unit member isnot scheduled to work shall receive a minimum of three (3) hours pay at the appropriate rate. This does not apply to pre-scheduled overtime. If the unit member is called to work but it isperformed off-campus (such as by remote device), the unit member shall be guaranteed a minimum of one (1) hour of work. However, this does not apply to work performed in de minimis time. De minimis time is defined by the FLSA as infrequent and insignificant periods of time beyond the scheduled working hours which cannot as a practical matter be precisely recorded for payroll purposes and therefore may be disregarded. The courts have held that such periods of time are de minimis (insignificant). This rule applies only where there are uncertain and indefinite periods of time involved, a few seconds or minutes in duration, and where the failure to count such time is justified by industrial realities.
