Operable Unit 3 definition

Operable Unit 3 or “OU 3” shall mean the Little Rapids to De Pere reach of the Lower Fox River, as delineated by the Record of Decision signed by WDNR and EPA in June 2003 (Dkt. 404-2). More specifically, OU 3 is the portion of the Lower Fox River (and the underlying River sediment) from the Little Rapids Dam downstream to the De Pere Dam.
Operable Unit 3 or “OU-3” shall mean property in or around the Zonolite Mine owned by ▇. ▇. ▇▇▇▇▇ or ▇▇▇▇▇-owned subsidiaries (excluding OU-2) and any area (including any structure, soil, air, water, sediment or receptor) impacted by the release and/or release and subsequent migration of hazardous substances and/or pollutants or contaminants from such property, including, but not limited to, the mine property, the Kootenai River and the sediments therein, ▇▇▇▇▇▇ Creek, ▇▇▇▇▇▇ Creek Road and areas in which tree bark is contaminated with such hazardous substances and/or pollutants and contaminants.
Operable Unit 3 or “OU3” shall mean the third reach of the Lower Fox River, as delineated by the Record of Decision signed by WDNR and EPA in June 2003. More specifically, OU3 is the portion of the Lower Fox River (and the underlying River sediment) starting at the Little Rapids Dam downstream to the De Pere Dam. As so defined, OU3 is depicted in Figure 7-26 of the December 2002 Final Feasibility Study, a copy of which is attached hereto as Attachment B-2.

  • Each PRP or NRD Trustee that has paid Environmental Restoration Expenses attributable to Operable Units 2 or 4 (or, in accordance with Section 3.05 of this Agreement, Operable Unit 3) of the Diamond Alkali Site may submit Invoices for the amounts it has paid to the ERRT Trustee for reimbursement from those funds in the Restoration Distribution Account available for such expenses pursuant to Article IX.B of the Plan.

More Definitions of Operable Unit 3

Operable Unit 3 means the following portion of the Diamond Alkali Site: the area defined by the EPA as the Newark Bay Study Area, encompassing Newark Bay and portions of the Hackensack River, ▇▇▇▇▇▇ Kill, and the Kill ▇▇▇ ▇▇▇▇.
Operable Unit 3 or “OU3” shall mean the Bonita Peak Groundwater System. The Bonita Peak Groundwater System generally includes the saturated and unsaturated workings of the Sunnyside Mine, associated drainage and haulage tunnels, nearby mines not known to be connected to the Sunnyside Mine by workings (e.g. Red & Bonita Mine and Gold King Mine), and the surrounding geographic area that may be hydraulically connected or influenced by current and/or historical releases from or management of these mines.
Operable Unit 3 or “OU3” shall mean that portion of the Site that generally includes the contaminated groundwater at the Site and the areal extent of such contaminated groundwater. OU3 also includes any Plant Area contaminated soils that cause or contribute to such groundwater contamination. Plant Area soils and groundwater are also referred to herein as the “Source Area” or “Source Area Soils and Groundwater.” If other sources are

Operable Unit 3 or “OU3” shall mean the response actions relating to the ground water contamination addressed by the ROD, as amended by the ROD Amendment. Record of Decision for the Site signed on August 10, 2000, by the Regional Administrator, EPA Region III, or his/her delegate and all attachments thereto. The ROD is attached as Appendix A.
Operable Unit 3 or “OU 3” shall mean that portion of the Site that includes the surface water, sediment, and sediment pore water contained within the bed of Davis Mill Creek (“DMC”) from its origin at the Headwaters iron calcine pile downstream to and including Dam No. 5. OU 3 includes portions of the Gypsum Ponds tributary, West Drainage Channel, Belltown Creek channel, and other seepage and discharge areas, as well as the Cantrell Flats water treatment plant, five storm water retention dams along DMC, the Belltown Creek diversion dam, the Belltown and Gypsum Ponds diversion pipelines and their rights of way, and the Dam No. 5 pump station.
Operable Unit 3 or “OU3” shall mean the portion of the OU 1 Study Area defined as being from the mouth of Newtown Creek at the East River (referred to as Creek Mile 0) to two miles up, or into, Newtown Creek (Creek Mile 2), excluding the Whale Creek and Dutch Kills tributaries of Newtown Creek. The OU3 portion of the Newtown Creek Study Area is depicted generally on the map attached as Appendix B.
