Phase I Completion Date definition

Phase I Completion Date means the date on which the Construction Supervisor issues a written notice (the "Phase I Completion Notice") to TEC certifying that the Phase I Performance Test has been completed.
Phase I Completion Date is hereby amended to read in its entirety as follows:
Phase I Completion Date shall have the meaning set forth in Section 9.2(a).

Phase I Completion Date means the date on which the Construction Supervisor issues a written notice (the "Phase I Completion Notice") to the Borrower and the Disbursement Agent certifying that (a) the process units and supporting facilities included in the definition of "Phase I" have reached Mechanical Completion in accordance with the Plans, as defined in the Disbursement Agreement and (b) for a period of at least 15 consecutive days, the Refinery has sustained (i) the successful performance of the Delayed Coking Unit, the Hydrodesulfurization Unit and the Sulfur Recovery System, (ii) an average feedstock throughput level of at least 150,000 barrels per day, and (iii) no net production of vacuum tower bottoms when using as input a combined feedstock slate with an average API Gravity of 22 degrees or less.
Phase I Completion Date means the date on which Phase I Completion occurs.
