Upon acceptance and commissioning by both Parties, the SPS in the Redundant SPS Configuration will be considered fully operational.
Testing and Start-up: NGrid, with Athens' assistance at its communication interfaces, will install, calibrate and test the Redundant SPS Configuration.
The Parties agree to operate the SPS in accordance with the operational criteria established in the Facility Study and the Redundant SPS Configuration Study.
NGrid, following receipt of written permission from Athens to proceed to final design, shall perform the final design and procure the necessary equipment for the Redundant SPS Configuration.
Two (2) months after Athens’ receipt of the Redundant SPS Configuration Study – The Redundant SPS Configuration Study is accepted by Athens, and final design and equipment/materials procurement can begin.

The Parties shall use Commercially Reasonable Efforts to install the Redundant SPS Configuration in accordance with Section 3.1 and the following schedule: Six (6) months after approval of this Agreement by FERC – NGrid provides the Redundant SPS Configuration Study for review and approval by Athens (the approval of Athens shall not be unreasonably withheld, conditioned or delayed).
Six (6) months after Athens’ acceptance of the Redundant SPS Configuration Study – NGrid completes final design of the Redundant SPS Configuration.
Furthermore, following the Effective Date, each Party shall use Commercially Reasonable Efforts to implement the Redundant SPS Configuration consistent with Section 3.2. Without limiting the foregoing, NGrid may permanently physically remove the SPS equipment if its own reliability reviews undertaken in accordance with Section 3.4 identify a reliability risk, whether imminent or not, to the Transmission System attributable to the SPS.
Configuration Study: Any study or design related costs set forth in the Redundant SPS Configuration Study to the extent not already paid pursuant to Section 4.1(c)(1).
