In respect of each Nomination Period, the Service Provider shall notify the Customer in writing of the Actual Utilisation Quantity (and where applicable any Shortfall Quantity) by no later than the start of the seventh (7th) Business Day following the Day in respect of which the Nomination was made.
Any Gas that fails to meet the Specifications that was rejected by Buyer in accordance with Clause 13 shall, for the purposes of determining the Shortfall Quantity, be considered as not having been made available by Sellers.
Notwithstanding any other provision of this Agreement, Sellers shall not be liable for any Shortfall Quantity, shortfall in Gas delivery or reduction in DCQ that arises from, is related to, or is caused by the GoI taking Gas in kind under the PSC.
