In the case of an audit performed by or on behalf of any Regulatory Authority of either the RHIO or the SHIN-NY, the Participant shall provide to the RHIO for delivery to the State Designated Entity or the Regulatory Authority such records related to this Agreement and the SHIN-NY as may be required by such Regulatory Authority.
The Participant shall not (nor shall the Participant authorize or permit any third party to) (i) create or attempt to create by reverse engineering or otherwise any Software or Tools of either the RHIO or the State Designated Entity or (ii) ascertain or attempt to ascertain the design or operation of any Software or Tools of either the RHIO or the State Designated Entity; or (iii) derive or attempt to derive the source code for any Software or Tools of the RHIO or the State Designated Entity.
The New York eHealth Collaborative (“NYeC”) works in partnership with the NYS Department of Health as the State Designated Entity (the “SDE”) responsible for operating and maintaining the SHIN-NY and does so in collaboration with the regionally based QEs and their Participants.
States will be expected to use their authority, programs, and resources to: – Determine roles and responsibilities of State Designated Entity (SDE), if desired – Develop and implement Strategic and Operational Plans – Develop state level directories and enable technical services for HIE within and across states.
