Taking for temporary use definition

Taking for temporary use means a Taking of ninety (90) days or less.

Examples of Taking for temporary use in a sentence

  • In case of a Taking for temporary use, there shall be no termination, cancellation or modification of this Lease, and Lessee shall continue to perform and comply with (except as such performance and such compliance may be rendered impossible by reason of such Taking) all of its obligations under this Lease and shall in no event be relieved of its obligation to pay punctually all Rent or any other charges payable hereunder.

  • In the event of a Taking for temporary use or occupancy, this Lease shall continue in full force and effect without reduction or abatement of any rent payable hereunder, and Tenant shall be entitled to claim, recover and retain any Award made on account of such temporary Taking; provided, however, that if the period of such temporary Taking extends beyond the Term, such Award shall be apportioned between Landlord and Tenant as of the date of expiration of the Term.

  • In the event of the Taking of an easement or any other taking which shall be of an interest or estate in the Property less than a fee simple (other than a Taking for temporary use mentioned in Section 12.8 hereof), as a result of which the Property shall be insufficient for the economic and feasible operation thereof by Tenant, this Lease shall terminate and expire with the same force and effect as in the case of a Taking pursuant to Section 12.3 hereof.

  • If there is a Partial Taking of the Leased Premises, except for a Taking for temporary use, the following shall apply.

  • When and if, during the term of this Agreement, the period of temporary use ceases, Owner shall make all such restoration, repairs and alterations as are necessary to restore the Resort to its condition prior to the Taking for temporary use.

  • In the event of a Taking, except for a Taking for temporary use, which Tenant considers to be a Substantial Taking, Tenant may, provided that all Lender(s) consent in writing thereto, deliver written notice to Landlord within sixty (60) days after Tenant receives Notice of Intended Taking, noti- fying Landlord of the Substantial Taking.

  • When and if during the term of this Agreement, the period of temporary use shall terminate, Westboy shall, to the extent condemnation proceeds are made available to Westboy for restoration, repair and alterations, make all such restoration, repairs and alterations as shall be necessary to restore such Hotel to its condition prior to such Taking for temporary use and shall complete the same with diligence.

  • Unless an Event of Default shall have occurred, all sums so received by Lessor, shall be applied in accordance with the provisions of Section 15.3, except that any such sums received with respect to a Taking for temporary use shall be applied in accordance with the provisions of Section 15.

  • If all of the Premises shall be taken, except for a Taking for temporary use, this Lease shall be cancelled automatically as of the Taking Date.

  • For purposes hereof, a "Taking for temporary use" shall mean a Taking of ninety (90) days or less.

Related to Taking for temporary use

  • Temporary use means a use or structure on improved or unimproved real estate which is of impermanent nature, and is used for less than ninety days in a calendar year.

  • Temporary service means an electrical service granted temporarily for such purposes as construction, real estate sales, trailers, et cetera;

  • Temporary beer event permit means a permit issued in accordance with Chapter 9, Part 4, Temporary Beer Event Permit.

  • Temporary Structure means any structure that is apparently temporary in nature;

  • Temporary license means a license issued on a short-term basis for a specified time pursuant to subrule 3.5(4).
