This Agreement (i) is not a lease and does not ▇▇▇▇▇ ▇▇▇ any real property rights in the Property or Public Trail Improvements, and (ii) shall not make HOA an agent for the City.
The foregoing indemnity includes, without limitation, all costs associated with the investigation and remediation of Hazardous Material and with the restoration of the Public Trail Improvements to its prior condition including, without limitation, fines and penalties imposed by regulatory agencies, natural resource damages and losses, and re-vegetation of the Property and the Public Trail Improvements.
At the Developer’s sole cost and expense, the Developer agrees to design and construct the Trail Improvements substantially in accordance with the Drawings.

To the extent the depiction of the Public Trail Improvements set forth in Exhibit A varies from the actual Public Trail Improvements constructed, then Exhibit A shall be modified to include the actual Public Trail Improvements constructed.
Subject to credit against and/or reimbursement from the Neighborhood Park Fee pursuant to the Credit Reimbursement Agreement, Developer shall be responsible for all costs associated with the design and construction of the Trail Improvements, including the costs of preparing the required plans and drawings and, if necessary, obtaining any and all other required permits and any required supplemental environmental analysis.
In addition to those Trail Improvements installed as part of the Project, the following amenities may be installed at a later date: light fixtures as recognized as an important amenity for the Manayunk Bridge Trail; benches; planters; and trash receptacles.
Subject to the terms of the applicable Credit Reimbursement Agreement, upon such acceptance, the Park Agency will reimburse Developer for all reasonable, documented costs of construction of the Trail Improvements from the Neighborhood Park Fee (less any amounts thereof then applied by Developer as credits against such Fee).
The Developer agrees that it will adhere to the following schedule for construction of the Trail Improvements, subject to unavoidable delays.
