Acknowledgement by Customer. I/We acknowledge that I/we have had adequate time to discuss this matter (in particular clause 5) with, and obtain advice from, our legal advisors in relation to all clauses stipulated in the above Transport Terms and Conditions. I/we have carefully read and fully understand all clauses and accept them in full.

Acknowledgement by Customer. 19.1 The Customer acknowledges that it has conducted its own due diligence and selected the products based upon its own skill and judgement (or that of its agents) and it has satisfied itself as to the suitability of the products based upon amongst other things, local conditions, your specific circumstances, and objectives, environmental factors and intended usage. Our representations are indicative only based upon past experience and no warranty as to fitness for any particular purpose is offered by us. 19.2 To the fullest extent allowed at law any representations made or alleged to have been made by us as to suitability for any specific purpose are denied and any representations made or alleged to have been made in and about the negotiations of this agreement or in relation to the products generally are expressly overridden by this agreement.

Acknowledgement by Customer. Customer acknowledges that it has read and reviewed the limitations of the Service as set forth in this Section 2 and CT’s 911 Notice and Disclaimer available at ▇▇▇▇▇://▇▇▇▇▇▇▇▇▇▇.▇▇▇/911-notice/ and affirmatively acknowledges that Service’s 911 dialing is different than traditional 911 service through a wired phoneline or other E911 Service. CUSTOMER’S SERVICE WILL NOT BE ACTIVATED UNTIL CT RECEIVES AN AFFIRMATIVE ACKNOWLEDGEMENT THAT CUSTOMER HAS READ AND UNDERSTOOD THIS SECTION 2 AND HAS RECEIVED A SIGNED 911 NOTICE AND DISCLAIMER.

Acknowledgement by Customer. The Customer acknowledges that Western Union has entered into this Agreement and will enter into the transactions contemplated by this Agreement in reliance on the representations and warranties in Section 2 above.

Acknowledgement by Customer. (a) Customer acknowledges that from and including October 10, 1995 Customer's Outstanding Advances have exceeded Customer's Borrowing Base and that, as of the close of business on December 12, 1995, Outstanding Advances exceeded the Borrowing Base in the approximate amount of $26,265,485. Customer acknowledges that, as a result thereof, Customer is in default to IBM Credit under the terms of the Agreement in that Customer has failed to repay the Outstanding Advances in an amount equal to the Shortfall Amount.

Acknowledgement by Customer. With respect to any Ongoing Enablement provided by ReliaQuest to Customer, the parties acknowledge and agree that, outside of Log Data, ReliaQuest shall not have access to any other data on Customer’s systems and Customer shall not provide any other such data to ReliaQuest. In addition, Customer acknowledges and agrees that ReliaQuest does not guarantee that there will be no third-party security breaches, problems, or threats to Customer’s network or systems. Customer acknowledges and agrees that ReliaQuest is only being engaged to help identify such threats and expressly agrees that ReliaQuest shall not be responsible under any circumstances in the event any such issues occur. Unless as otherwise agreed in writing, in no event will Customer provide access to or transmit to ReliaQuest (via Log Data or otherwise) any personally identifiable information, protected health information, or other personal information that is subject to data privacy or security laws or regulations.

Acknowledgement by Customer. The Customer acknowledges that the computer servers used to host or otherwise provide the HybridHero Operating Environment and App are located in Australia, United Kingdom, any member state of the European Union (including Poland), India and Sri Lanka.

Acknowledgement by Customer. The Customer acknowledges and agrees ROL Holder may, from time to time, add chemicals to water in the Distribution Network for overall maintenance purposes including weed control and that such chemicals will affect water quality.
