Additional Available Hours. (a) Regular part-time employees shall be given first opportunity to work additional available hours. The employment status of such employee will not be changed. Employees called in to work on an unscheduled work day will be paid their regular straight time hourly rate for all hours worked subject to Article 26:04(c) above. Should an employee not be able to work such additional hours due to illness sick leave shall not apply. (b) The Employer and the Union agree that additional available hours will be allocated in accordance with the following: (i) On the day of the occurrence Step 1: Approach staff already at work, or scheduled, in order of seniority. Step 2: Use the call sheet for the day, in order of seniority. Step 3: If overtime cannot be avoided, go to the most senior employee already at work. (ii) In advance of the day (c) Notwithstanding the provision of Article 26:06(a) and 26:06(b), the Employer shall not be compelled to schedule an Employee for overtime if a less senior Employee is available to work at straight time. If overtime cannot be avoided, the Employer will call Employees in order of seniority.
Additional Available Hours. During the course of the school year, additional hours will be assigned to fluctuating drivers in an effort to bring their daily route hours average to eight (8) hours per day.
Additional Available Hours. A regular part-time employee shall be offered additional available hours in his or her classification before such is offered to a casual employee if the part-time employee has previously notified the employer in writing of the hours he is available for additional work.
Additional Available Hours. The Employer will assign additional available hours, up to four (4) hours per day, to the most senior employee then working who is willing to stay and work those hours. The Employer will not be required to assign additional available hours to an eligible employee if doing so would result in the Employer having to compensate the employee for overtime on a daily or weekly basis. Additional available hours of four (4) or more may be assigned by either extending the shift of the most senior employee working or on a call- in basis.

  • Valid Issuance; Available Shares; Affiliates All of such outstanding shares are duly authorized and have been, or upon issuance will be, validly issued and are fully paid and nonassessable. Schedule 3(r)(iii) sets forth the number of shares of Common Stock that are (A) reserved for issuance pursuant to Convertible Securities (as defined below) (other than the Notes and the Warrants) and (B) that are, as of the date hereof, owned by Persons who are “affiliates” (as defined in Rule 405 of the 1933 Act and calculated based on the assumption that only officers, directors and holders of at least 10% of the Company’s issued and outstanding Common Stock are “affiliates” without conceding that any such Persons are “affiliates” for purposes of federal securities laws) of the Company or any of its Subsidiaries. To the Company’s knowledge, no Person owns 10% or more of the Company’s issued and outstanding shares of Common Stock (calculated based on the assumption that all Convertible Securities (as defined below), whether or not presently exercisable or convertible, have been fully exercised or converted (as the case may be) taking account of any limitations on exercise or conversion (including “blockers”) contained therein without conceding that such identified Person is a 10% stockholder for purposes of federal securities laws).

  • Subsequent Recalculation In the event the Internal Revenue Service adjusts the computation of the Company under Section 5.2 herein so that the Executive did not receive the greatest net benefit, the Company shall reimburse the Executive for the full amount necessary to make the Executive whole, plus a market rate of interest, as determined by the Committee, within 30 days after such adjustment.

  • Minimum Hours All employees shall be paid their regular hourly rate for each hour worked except where employed for less than four (4) consecutive hours per day, in which event they shall receive a minimum of four (4) hours pay. An employee who is called for work and upon reporting finds that his or her services are not required shall receive two (2) hours pay.

  • Reduction in Hours (a) Reduction in hours shall be based on seniority, providing that affected employees have the qualifications to perform the work that is available and that licensing standards can be maintained. (b) Any regular employee offered a reduction of hours shall have the right to choose layoff as per Article 13.3. (c) Any regular employee offered a reduction of hours shall be given two (2) weeks’ notice of the reduction.

  • Night Shift Premium All hours worked by an employee between ten (10:00) p.m. and seven (7:00) a.m. shall be considered as shift work and paid for at the applicable straight time/overtime rate plus two ($2.00) dollars per hour shift premium for each full hour worked during this period. Night-shift premium shall not be added to the employee’s hourly rate of pay for the purpose of computing overtime pay.
