Administrative Record Sample Clauses
The Administrative Record clause defines the collection of documents and materials that form the official basis for decision-making in a legal or regulatory proceeding. Typically, this includes all records, correspondence, reports, and evidence considered by the relevant authority when making its determination. By clearly establishing what constitutes the administrative record, this clause ensures transparency, facilitates judicial review, and prevents disputes over which materials can be referenced or challenged in subsequent appeals or litigation.
Administrative Record. A. The DOE shall establish and maintain an Administrative Record for the site. A complete copy of the Administrative Record shall be available to the public at the DOE reading room in Aiken, South Carolina. In addition, copies of the current index to the Administrative Recor d and selected document s from the Administrative Record shall be available at other locations.
B. The selection of each response action shall be based on the Administrative Recor d, in accor dance with Section 113(k) of CERCLA, 42 U.S.C. § 9613(k), any regulations promulgated pursuant to that Section and any applicable guidance. A copy of each Administrative Recor d or a com plete index of each Administrative Recor d shall be maintained a t EPA's Region IV office, currently a t ▇▇▇ ▇▇▇▇▇▇▇▇▇ ▇▇▇▇▇▇, ▇. ▇., ▇▇▇▇▇▇▇, ▇▇▇▇▇▇▇, ▇▇▇▇▇.
C. Upon request by EPA or SCDHEC, the DOE shall provide copies of document s generated or possessed by DOE that are included in the Administrative Recor d to the requesting Party. The EPA and SCDHEC shall provide DOE with copies of document s generated by each agency which should be included within the Administrative Record.
D. Upon establishment of an Administrative Record, the DOE shall provide EPA and SCDHEC with an index of the Administrative Recor d. The index shall identify the documents which will comprise the Administrative Record for each decision document for each particular response action.
E. The DOE shall provide to EPA and SCDHEC, in its fiscal year written progress reports, a periodic update of the indices of the Administrative Recor ds and/or Administrative Recor d Files that includes any changes or additions to the Recor d. The Project Managers shall review the Administrative Recor d Indices and the Administrative Recor d File Indices to ensure that the Administrative Records and Administrative Record Files are current and complete.
F. The EPA shall provide the DOE with guidance on establishing and maintaining the Administrative Record as the guidance is developed.
Administrative Record. 1. The CAR shall establish an Administrative Record that contains the documents that form the basis for the selection of a cleanup plan. Documents in the Administrative Record shall include the ABCA; site investigation reports; the cleanup plan; cleanup standards used; responses to public comments; and verification that shows that cleanup is complete. The CAR shall keep the Administrative Record available at a location convenient to the public and make it available for inspection. The Administrative Record must be retained for three

Administrative Record. NASA shall establish and maintain administrative records for the selection of response actions in accordance with CERCLA § 113(k), 42 U.S.C. § 9613(k), Subpart I of the NCP, 40 C.F.R. Pt. 300, Subpart I, and applicable EPA guidance.

Under 1.1B, give WAPA all documents ,correspondence related to the review, meeting notes and meeting summaries, copies of all information provided to stakeholders, copies of correspondence received, copies of reports, data and other information produced by the Customer to support the environmental reviews, oral and written comments received from stakeholders; results of coordination with local, state, and appropriate Federal agencies, landowners and other interested citizens or groups (e.g. environmental groups) so that WAPA may complete the Administrative Record, at the Customer’s sole expense.

Develop a draft filing protocol/guidance that designates the types of documents that should be filed and information that should be included in the administrative record database about each document. • Revise filing protocol/guidance based on consolidated INDOT review comments. • Develop the administrative record database in accordance with the filing protocol. The database will include all technical reports, meeting summaries, telephone memos, correspondence with agencies and stakeholders, comment/response matrices, and other relevant documents that were considered directly or indirectly in the decision-making process.
