Alternative Project. The Company agrees to construct or procure an alternative project the nature and the timing of which is to be determined at the sole discretion of the Company. The Company, at its cost, shall be solely responsible for obtaining all permits and approvals necessary for such alternative project.
Alternative Project. 5.1 The Company agrees to construct or procure an alternative project the nature and the timing of which is to be determined at the sole discretion of the Company. The Company, at its cost, shall be solely responsible for obtaining all permits and approvals necessary for such alternative project. 5.2 The estimated cost of the alternative project shall be not less than the estimated cost of constructing the Lyric Theatre of $42 million, the amount determined on 9 March 2001 by a quantity surveyor appointed by the State. 5.3 The Company shall submit drawings, plans, specifications and details relating to the alternative project to the State so that the State may have the estimated cost thereof verified by a quantity surveyor to be appointed by the State, acting reasonably. If the estimated cost so verified is less than $42 million, the Company agrees to construct or procure a further stage or stages of the alternative project (the nature and the timing of which is to be determined at the sole discretion of the Company) to make up the shortfall in estimated cost. Clauses 5.1 and 6, and the verification process in this clause apply to any such further stage.

  • BUILDER’S RISK FOR NEW CONSTRUCTION PROJECTS If the project is NEW CONSTRUCTION, then the following provisions apply: (1) The State will require Contractor to purchase and maintain Builder's Risk Insurance. The Contractor shall name the Contractor and the State of Vermont as their interest may occur. Other parties shall be insured as the State may reasonably require. (2) Contractor shall effect and maintain insurance on portions of the work stored off-site, on site and in transit. Boiler & Machinery Insurance may be used in conjunction with this coverage if it is required to meet the testing requirement. (3) Any deductible applicable to loss covered by insurance provided hereunder shall be borne by the Contractor. (4) Except as provided for in (1) above the State and Contractor waive all rights against each other and the Subcontractor, Sub-subcontractors, agents and employees of the other.

  • Improvement Plan A detailed, written plan initiated by the evaluator. The teacher may provide input at the meeting to review the plan. Improvement plans are utilized when a teacher receives an Evaluation Rating of Ineffective or when an administrator utilizes discretion to place any teacher on an improvement plan at any time based on any individual deficiency in the evaluation system. The approved form for the Improvement Plan is attached to this agreement as Appendix A-9.
