Common use of Assignments and transfers by the Lender Clause in Contracts

Assignments and transfers by the Lender. Subject to this Clause 22, the Lender (the "EXISTING LENDER") may: (a) assign any of its rights; or (b) transfer by novation any of its rights and obligations, to another bank or financial institution (the "NEW LENDER") at the cost and expense of the Existing Lender and/or the New Lender and with prior notice to but otherwise without the prior consent of the Borrower.

Assignments and transfers by the Lender. Subject to this Clause 22, the a Lender (the "EXISTING LENDER") may, at its own cost and expense, without the consent of the Borrower: (a) 22.1.1 assign any of its rights; or (b) 22.1.2 transfer by novation any of its rights and obligations, to another bank or financial institution or to a trust fund or other entity which is regularly engaged in or established for the purpose of making, purchasing or investing in loans, securities or other financial assets (the "NEW LENDER") at the cost and expense of the Existing Lender and/or the New Lender and with prior notice to but otherwise without the prior consent of the Borrower).
