10.02 Where a prospective Long Term Occasional Teacher is required to attend negotiation meetings during the period required to qualify for a Long Term Occasional position, the day(s) spent at negotiations shall be considered as teaching day(s) for the purpose of accumulating the required number of teaching days, and the Long Term Occasional Teacher shall be paid by the Board, the daily rate of an Occasional Teacher for such day(s) spent in negotiations.
10.03 The Association and the Board agree that there shall be no discrimination, intimidation, restraint or coercion exercised by the Association or any of its members or by the Board with respect to any employee of the Board on the basis of membership in the interest Association or lawful activity of resolving grievances at the earliest possible step, it may be beneficial that other individuals, not specifically designated, be in attendance provided that their presence will not interfere with or interrupt normal school or work facility operations. (a) No Occasional Teacher shall leave his/her assigned duty to attend Association business without the consent of the Human Resource Officer or designate.
(b) The Association President shall serve written notice and/or employees covered by this Agreement will not engage in Association activities during working hours or hold meetings at any time on the premises of the Board without the permission of the Human Resource Officer.
(c) Occasional Teachers may request the use of a room to the OCB Deputy Director identifying employeesconduct Association business. Where feasible, the employee designated to attend such meetings This request shall be an employee of approved by the Employing Agency in which the grievance was filed. An Association representative who is an employee shall be granted administrative leave with pay, per Section 4.07(B), to attend a meeting held to facilitate the adjustment of a grievance, so long as attendance immediate supervisor provided that it does not adversely impact the adequacy of the workforce at the Employing Agency.

C. The Association shall be the exclusive representative of the employee in all matters pertaining to the enforcement of any rights of the employee under the provisions of this Article and in accordance with Chapter 4117.03(A)(5) of the Ohio Revised Code.

The Association shall have the final authority in respect to any aggrieved employee, to decline to process a grievance to arbitration if, in the judgment of the Association, the grievance lacks merit or justification under the terms of this Agreement or has been adjusted or rectified under the terms of this Agreement to the satisfaction of the Association. At any Step in the grievance procedure, the Association may decline to file an Association grievance or to withdraw an Association grievance for good reason.
E. In the event an employee refuses or fails to attend a mediation, an arbitration, or any other alternative dispute resolution proceeding, the Association must proceed interfere with the hearing instructional program or withdraw the grievancecommunity use.

5.07 Time Extensions and Step Waivers
A. The Grievant or the Association representative and representatives of the Employer may mutually agree in writing at any step to a short time extension. Any step in the grievance procedure may be waived by written mutual consent. In emergency situations as defined by the Governor, an Appointing Authority, Employing Agency Director, or the OCB Deputy Director, the grievance step time limitations shall be suspended for the duration of the emergency. In the absence of such extensions or emergency situations, at any step where a grievance response of the Employer has not been received by the Grievant and the Association representative within the specified time limits, the Grievant may file the grievance to the next successive step in the grievance procedure within the same number of days from the date the decision was due as specified in Section 5.06 of this Article. Except as provided above, grievances shall be processed within the specified time limits.
