UNION REPRESENTATION. 9.01 The Union shall notify the Employer of the names of its representatives as follows: officers, bargaining committee members, health and safety representatives and a maximum of two (2) local representatives. (a) The Union acknowledges that the representative has regular duties to perform on behalf of the Employer, therefore, the representative shall normally conduct his/her activities outside regular working hours. (a) In a situation which requires a representative’s attention during working hours, he/she shall not leave his/her regular duties without first obtaining permission to do so from his immediate supervisor. It is understood that the taking of such time away from regular duties shall be kept to a minimum and that permission will not therefore be unreasonably withheld. The Representative shall return to his/her regular duties as expeditiously as possible. The Employer reserves the right to limit such time if the time requested is unreasonable. 9.03 Employees and Union representatives who attend grievance meetings shall not lose pay for their regularly scheduled hours. 9.04 The Employer recognizes the right of the Union to appoint or otherwise select two (2) employees to the Negotiating Committee. It shall be the Negotiating Committee’s function to meet with the Employer to negotiate the renewal of this Agreement. 9.05 The Employer shall allow reasonable access to the Employer’s premises by a staff representative of the Union for the purpose of consulting with the local representative of the Union with regard to Union matters, or the Employer. It is agreed such visits will be during normal business hours and timed to cause as little disruption as possible to the normal conduct of the business. Such consultations with the local representative shall be in a place designated by the Employer and time taken shall be kept to a minimum. 9.06 Union Representation Subject to 9.07, employees shall be entitled to Union representation at meetings where discipline is to be imposed or at any investigatory meeting that may result in discipline. If such a request is made, and a Union Representative is not immediately available, the meeting between the Employee and the Employer will be delayed for a reasonable period of time until the Union Representative becomes available in which case the Employee may be held out of service without pay. 9.07 The parties recognize the need for expediency in the event of accident investigations. UNION REPRESENTATION. 3.01 For the purpose of representation with the Employer, the Union shall function and be recognized as follows: a. The Union may appoint up to two (2) stewards. Stewards are representatives of the employees in certain matters pertaining to this Agreement, including the processing of grievances. b. Union Representatives are representatives of the employees in all matters pertaining to this Agreement, particularly for the purpose of processing grievances, negotiating amendments to and renewals of this Agreement and enforcing the employees' collective bargaining rights as well as any rights under this Agreement and under the law. 3.02 The Union agrees to notify the Employer in writing of the names of its stewards and the effective dates of their appointments. The Employer shall not be required to recognize a ▇▇▇▇▇▇▇ until such notice is received. 3.03 Stewards will not absent themselves from their work to deal with grievances without first obtaining permission from the Employer. Permission will not be withheld unreasonably. Stewards that are absent from work to attend a grievance arbitration, mediation, or any other proceeding that arises from the administration or enforcement of this Agreement will not receive their regular hourly rate. 3.04 The Employer may meet periodically with the employees for the purpose of discussing any matters of mutual interest or concern to the Employer, the Union and the employees. A Union Representative may attend such meetings. 3.05 There shall be no Union activity at any time on the Employer's premises, or in connection with the Employer’s business operations, except that which is necessary for the processing of grievances and the administration and enforcement of this Agreement. 3.06 Union Representatives shall have the right to periodically visit job sites without disrupting productivity and without unreasonable intrusion into the Employer or its clients’ premises. The Union’s Representative shall report to the site superintendent, or ▇▇▇▇▇▇▇ upon arriving at a worksite, and shall abide by all necessary protocol as determined by the general contractor, the Employer, or the client.
UNION REPRESENTATION. 5.01 The Company recognizes the Union Stewards duly identified by the Union. 5.02 The Union shall elect or appoint the above mentioned stewards and shall send the Company written notification of the names of these stewards. Moreover, the Union shall inform the Company of any subsequent changes including any stewards added or withdrawn. 5.03 The Union recognizes that Union Stewards, as defined in the present Collective Agreement, and all employees, have regular work to perform for the Company and that they may not leave their respective jobs except with permission from their Supervisor, such permission not to be unreasonably withheld. 5.04 An employee who wishes to leave his job under article 5.03 will make a request to his Supervisor who will authorize it based on the Company’s operating policies and schedules. The Union shall have the right of posting Union notices of direct interest to the employees at all locations at which Union members are employed, in line with the Canada Labour Code. The Union undertakes to supervise the material posted on the bulletin board so that offensive matters will not be posted and will provide the Company with a copy of all notices before posting. In addition, employees will not be allowed to wear clothes or accessories of a political nature on work premises unless he has obtained prior authorization from the manager of the Company or his authorized representative. The Company will provide the Toronto base with office space for the Union and the GSE with glass bulletin board. The Company will provide the Montreal base with office space for the Union. 5.06 The Company shall liberate up to a maximum of ten (10) Union Stewards (to be assigned as the Union sees fit) for negotiations. The Company shall pay for all regular hours spent in negotiations with a maximum of 8 hours per day or time lost for their scheduled shift, whichever is greater.” 5.07 The Company will liberate six (6) stewards for the quarterly meetings of labour relations with the Company. UNION REPRESENTATION. 5.01 The Employer recognizes the right of the Union to appoint up to 2 stewards to represent each Department, providing that such stewards are employed in the Department, or were employed in the Department under the most recent Agreement. Where the Union consolidates departmental representation, the ▇▇▇▇▇▇▇(s) must be employed in 1 of the consolidated Departments the employee represents. Where a member of the Union bargaining committee encounters an unavoidable conflict between any scheduled contract hours arising from appointment as an employee and attendance at a scheduled negotiation meeting with the Employer, the member of the Union bargaining committee shall be entitled to attend the negotiation meeting without loss of pay or needing to make up the missed work, up to and including the first day of conciliation. The affected member shall provide their Employment Supervisor with as much advance notice as possible. (c) For any subsequently scheduled days with the Employer the Employment Supervisor will endeavor, subject to operational requirements, to provide alternative work arrangements to allow the Union bargaining team members to participate in negotiations without loss of pay. (a) The Parties recognize that all employees in the bargaining unit, including Stewards, bargaining team members and Local Executive Members, have regular duties to perform as employees of the Employer. UNION REPRESENTATION. 5.01 The Union may appoint or otherwise select employees to serve as stewards and chief stewards whose duties shall be to assist employees in presenting their grievances to the designated representatives of the Company in accordance with the Grievance Procedure. (a) It is affirmed that any bargaining unit member who has cause to complain or who is the subject of a complaint under the Company harassment policy may request the presence of a Union representative at any step of the complaint procedure. The function of the Union representative shall be to act as a witness with respect to the content of the meeting. (b) The Company harassment policy will be conspicuously posted in the workplace. 5.02 The Union shall also establish a Shop Committee comprising of not more than three (3) employees selected by the union. UNION REPRESENTATION. 7.1 The Local may appoint a Collective Bargaining Committee, which shall consist of not more than four (4) Employees appointed by the Local. The Employer shall be advised of the names of the committee members prior to the commencement of negotiations. The Local members so selected shall not suffer any loss of regular pay or other benefits for time spent in meetings with the Employer on negotiations for a new collective agreement but shall not be eligible for overtime payments for time spent in such meetings which are conducted in other than regular working hours. 7.2 The Local shall not be prevented by the Employer from having the assistance of a representative from the Union when meeting with the Employer as required in the grievance procedure or for collective bargaining. The Union representative may have access to Employer's premises for such purposes only with prior notice to the Employer. Reasonable access will not be withheld. 7.3 The Employer shall be provided with a list, in writing, of all Local officers and their terms of office and shall be advised, within thirty (30) days, of any changes to that list. The Employer shall supply the Local with a list of supervisory personnel with whom the Local may be required to transact business and shall supply the Local, within thirty (30) days, of any changes to that list. (a) The Employer acknowledges the right of the Local to elect Stewards. The Employer shall be notified, within thirty (30) days, on any change to the list of Stewards. (b) Each ▇▇▇▇▇▇▇ has their regular work to perform on behalf of the Employer. However, if it is necessary to process a grievance during regular working hours, a ▇▇▇▇▇▇▇ will do so as expeditiously as possible. (c) A ▇▇▇▇▇▇▇ or their alternate shall obtain the permission of their immediate supervisor before leaving their work to perform their duties as a ▇▇▇▇▇▇▇. Such permission will not be unreasonably withheld. UNION REPRESENTATION a. The Union has the right to appoint stewards to a maximum of two (2). The Union agrees to notify the Employer in writing of the names and effective dates of stewards. These quarterly meetings may be attended by Representatives of the Union. The Union will schedule and give notice to staff and management of the times a Union Representative will be available to staff in a location determined by the Employer on its premises. At those times staff may meet with them during staff breaks or outside their scheduled work time. UNION REPRESENTATION. 5.01 The Local Union may appoint or otherwise select a bargaining committee which shall be composed of not more than seven (7) employees one of whom will be designated as an alternate, and one of whom shall be employed in maintenance. Such committee, together with representatives of the Union shall represent the Union in all negotiations with representatives of the Board for a renewal of this Agreement. The local union shall notify the Board in writing of the names of its bargaining committee members prior to the start of negotiations. 5.02 The Local Union may also appoint or otherwise select up to seven (7) stewards one of whom will be selected as the Chief ▇▇▇▇▇▇▇. One of such stewards shall be designated to represent the employees engaged in caretaking in each Field Service Area of the Board, and one of such stewards shall be designated to represent those engaged in maintenance, courier, and warehousing services. The Board will compensate stewards and Union officers for any portion of their regularly scheduled work time spent with the permission of the Board in servicing grievances. The Board may revoke this compensation if it reasonably believes that the time off for servicing grievances is being abused. 5.04 Members of the bargaining committee shall suffer no loss in pay for any portion of their regularly scheduled work time spent in attending negotiations with the Board. 5.05 The Local Union shall notify the Board in writing of the names of its officers, Chief ▇▇▇▇▇▇▇ and stewards. 5.06 The President of the Local union shall be supplied a copy of Board Corporate Services and Human Resources Committee meeting agendas and Regular Board meeting agendas, 48 hours prior to the meeting/s.
