Authorization for Fair Share. All employees in the Union bargaining unit who, do not become and remain members of the union 190 days from the date of graduation from the Fire Training Center, at the Union’s option communicated in writing to the City’s Human Resource Director, are required to pay the Union a fair share fee as permitted by the provisions of Section 4117.09 (c) of the Ohio Revised Code. The fair share fee amount shall be certified to Management by the Secretary Treasurer of the Union. Nothing herein shall be construed as requiring any employee in the bargaining unit to become a member of the Union as a condition for serving or retaining employment or any benefits under this agreement. The Union agrees to hold Management harmless for any damages that may be paid to any person or persons for enforcement of this provision. This deduction of a fair share by the public employer from the payroll check of the employee and its payment to the Union is automatic and does not require the written authorization of the employee.
