Common use of Availability of Service Clause in Contracts

Availability of Service. 9.1 Subject to the requirements of Applicable Law, ▇▇▇▇ Atlantic shall be obligated to provide ▇▇▇▇ Atlantic Services to Reseller under this Agreement only where ▇▇▇▇ Atlantic is able, without unreasonable expense (as determined by ▇▇▇▇ Atlantic in its reasonable judgment), (a) to obtain, retain, install and maintain suitable facilities for the provision of such ▇▇▇▇ Atlantic Services, and (b) to obtain, retain and maintain suitable rights for the provision of such ▇▇▇▇ Atlantic Services.
