The "Beyond Our Control" clause, often referred to as a force majeure clause, defines circumstances under which a party is excused from fulfilling contractual obligations due to events outside their reasonable control. This typically covers situations such as natural disasters, war, strikes, or government actions that prevent performance. By specifying these exceptions, the clause protects parties from liability when unforeseen events make it impossible or impractical to carry out the contract, thereby allocating risk and ensuring fairness in extraordinary situations.
Beyond Our Control. To the maximum extent permitted by law, neither We, nor any member of the Company Group, will have Liability for any loss or damage nor any delay which results from any cause beyond Our control, including any loss or damage occurring in the course of the provision of Ancillary Services by Third Party Providers or Services by Third Party Removalists. We will not be liable for loss or damage to the Goods caused or contributed to by You or someone else that We are not responsible for at law.
Beyond Our Control. As per our terms and conditions we will not pay any compensation, reimburse expenses, or cover losses for any amount or otherwise accept responsibility if we have to change your Package after booking, or our sup- pliers, cannot supply your Package, or you suffer any loss or damage of any description, as a result of circum- stances beyond our control. When we refer to circumstances beyond our control, we mean any event that we, or the supplier in question, could not foresee or avoid, even after taking all reasonable care. Such circumstances will usually include but are not limited to, war, terrorist activity, civil unrest, industrial dispute, bad weather and significant building work outside your accommodation, which is not known to us in advance of your departure date and building work from a third party.
Beyond Our Control. The credit union will not be liable if circumstances are beyond our control such as 1) interruption of telephone service or telecommunication facilities, or natural disaster (such as a fire or flood) prevent the transfer, despite reasonable precautions that we have taken; 2) if operating systems were not working properly and you knew about the breakdown when you started the transfer; 3) you have not properly followed the instructions for using HomeLink services; or 4) your operating system or software was not properly installed or functioning properly. Neither the credit union nor any software supplier nor information provider are liable for any computer virus or software-related problems which may be attributable to software or the services provided in connection with HomeLink services.

  • EVENTS OUTSIDE OUR CONTROL 10.1 We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under this ▇▇▇▇ that is caused by any act or event beyond our reasonable control, including failure of public or private telecommunications networks (Event Outside Our Control). 10.2 If an Event Outside Our Control takes place that affects the performance of our obligations under this ▇▇▇▇: (a) our obligations under this ▇▇▇▇ will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control; and (b) we will use our reasonable endeavours to find a solution by which our obligations under this ▇▇▇▇ may be performed despite the Event Outside Our Control.

  • SUBSIDY CONTROL 33.1 The Contractor should obtain its own advice as to whether the Subsidy Control Rules apply to the Funding received in relation to the Services delivered under this Contract. Guidance on this can be found at Complying with the UK’s international obligations on subsidy control: guidance for public authorities - ▇▇▇.▇▇ (▇▇▇.▇▇▇.▇▇). 33.2 Where the rules on Subsidy Control apply, the Contractor must: 33.2.1 comply with the relevant notification requirements; and 33.2.2 collect and retain appropriate records and will supply those records to the Department on its request. 33.3 The Department reserves the right to require the Contractor to obtain a contribution towards the cost of the Services delivered under this Contract from the employer of any Learner. Where a contribution is required, the Department will confirm to the Contractor in writing the exact percentage of the contribution. 33.4 Where the Department requires the Contractor to obtain a contribution towards the cost of the Services under Clause 33.3 above, the Contractor must provide evidence that the contribution has been received. 33.5 If a recovery order or any other enforcement measure is taken under the Subsidy Control Act 2022, the Contractor will repay the relevant subsidy to the Department within 28 days or such other timescale that the Department agrees with the Contractor.

  • Erosion Control a. The Purchaser shall construct slash and debris erosion barriers, dips, water bars or ditches in skid trails and landings as directed by the Forest Officer. b. The kinds and frequency of erosion control structures shall be adjusted to soil types, topography and climatic conditions as directed by the Forest Officer. c. The Purchaser is required to recontour any excavated skid trails, and provide for effective erosion control in the trail location as directed by the Forest Officer. d. Erosion control work shall commence as soon as skidding is completed on each skid trail or landing, and must be kept current with unit operations. e. Erosion control work shall be completed and approved by the Forest Officer in unfinished units before operations cease for inactive periods including heavy winter snowfall, spring breakup and restricted dates. f. All erosion control work in each unit shall be completed prior to notification pursuant to Section VII.M.7.
