BID REJECTION. The City of Reading reserves the right to reject any or all bids and to accept or reject any part of any bid. It also reserves the right to waive any technical defects or minor irregularities, which in its discretion, is determined to be in the best interest of the City.

"Bidder shall have the right to increase the contract unit price in an amount equal to the bidder's increase in costs for materials and supplies occurring subsequent to the date on which such bid is submitted (hereinafter referred to as "date base" to the board having authority to award contracts. In the event the cost to the bidder for the material and supplies is decreased subsequent to the date on which such bid is submitted the Board having authority to award contracts the bidder shall decrease the contract unit price to the City. Any increase (or decrease) in the bidder's cost material and supplies after the base date shall include proof of price to the bidder from the bidder’s source of supply. Should the bidder's allocation of any item be materially reduced by the bidders source of supply, the bidder may reduce proportionately the quantity of such item to be delivered in accordance with this bid. The City may withdraw or reduce the quantity of any item or terminate or reduce the scope of the contract:-
BID REJECTION. 11.1 The Bidder’s failure to submit required information may cause its Bid to be rejected. Additionally, a Bid received after the Bid Response Due Date and Time SHALL BE DEEMED NON- RESPONSIVE AND SHALL NOT BE CONSIDERED unless the State Purchasing Director has authorized acceptance of Bids due to a significant error or incident that occurred which affected the receipt of a Bid.8 Failure to comply with these Bidder Instructions may result in the Bid being disqualified from evaluation. 11.2 A Bid may be rejected when the Bidder imposes terms or conditions that would modify requirements. Other possible reasons for rejection of Bids are listed in OAC 260:115-3-5 and 260:115-7-32(h)9. 11.3 Attempts to impose unacceptable conditions on the State or impose alternative terms not in the best interest of the State may result in rejection of the Bid even if initially determined to be responsive or the State may cease any negotiations regarding the Bid. 11.4 Whenever the terms “shall”, “must”, “will”, or “is required” are used, the specification being referred to is a mandatory specification. Failure to meet any mandatory specification may cause rejection of a Bid. 11.5 Whenever the terms “can”, “may”, or “should” are used, the specification being referred to is a desirable item and failure to provide any item so termed shall not be cause for rejection of a Bid.
BID REJECTION. Issuance of this bid in no way constitutes a commitment by the University to award a Contract. The University reserves the right to accept or reject any or all Bids submitted or to cancel this bid if it is in the best interest of the University to do so. Grounds for the rejection of bids include, but shall not be limited to: • Failure of a Bidder to conform to the essential requirements of the bid. • A Bid imposing conditions that would significantly modify the terms and conditions of the solicitation or limit the Bidder’s liability to the University on the Contract awarded on the basis of such Solicitation. • Failure of the Bidder to sign the bid. This includes the Certification FormBids received after the bid due date and time specified in the bid.
BID REJECTION. MDT reserves the right to reject any or all bids and waive non-substantive technicalities as may be deemed necessary in the interest of the State of Montana.
BID REJECTION. Bidders shall not place any qualifications, exceptions, conditions, reservations, limitations, or substitutions in their bid concerning the contract terms and conditions. Any such qualifications, exceptions, conditions, reservations, limitations, or substitutions shall result in rejection of bid. Bids that are improperly submitted or received late will be documented for record, will not be returned, nor will bidder be notified. The following is a partial list whereby a bid response will be rejected: --Bid number not on envelope/package/box --Bid response with multiple bid numbers in same envelope not properly identified --Bid responses received late --Bid response not signed/not original signature --Bid response not notarized/not original signature of notary/or notary expiration --Bidder notarized own signature --Required information not submitted with bid response --Failure to submit the original bid and two copies --Bid response received from non-subscribed/expired vendor
