Billable Service Calls. A “Billable Service Call” is any Service, other than Covered Support, performed by JIA. Billable Service Calls will be charged to Customer according to the JIA’s billable rates in effect at the time the Service is performed. All charges for Billable Service Calls shall be paid by Customer within the terms set in the Order Form, otherwise within the due date on the invoice if not detailed on the applicable Order Form. Failure to comply with this shall cause a default of this Agreement, and interest will be charged on the past due balances at an annualized rate of eighteen percent (18%) (1.5% per month) or the maximum allowed by law, whichever is less. In the event of Billable Service Calls being performed at Customer’s location, each additional hour of service in a single day, beyond the first eight hours, may be billed at a rate equal to one hundred fifty percent (150%) of the normal rate in effect at the time. Billable Service Call rates will not increase by more than ten percent (10%) annually while Customer is not in default of this Agreement. For purposes of clarification, a Billable Service Call includes, but is not limited to, the following types of Services: 2.1 Work requested by Customer for the creation of new software programs, or the enhancement, modification or customizing of the Software or existing Services. 2.2 Correcting or changing data at the request of Customer, not caused by an error in the Software. 2.3 Services to install new versions of the Software or Services, which may also include enhancements to previously changed or customized Software or Services where the new version of the Software or Services does not contain the change or customized feature previously installed for Customer. 2.4 Work required to correct the Software or Services or related settings or configurations which have been modified by the Customer or party other than JIA. 2.5 Work required to correct errors, bugs, or problems which would not have occurred if the Customer was running the current release of the Software or Services. 2.6 Training, consulting or advising consultants, contractors, or any third parties at the request of Customer outside of any online training made available in Covered Support.

  • Scope of Interconnection Service 1.3.1 The NYISO will provide Energy Resource Interconnection Service and Capacity Resource Interconnection Service to Interconnection Customer at the Point of Interconnection. 1.3.2 This Agreement does not constitute an agreement to purchase or deliver the Interconnection Customer’s power. The purchase or delivery of power and other services that the Interconnection Customer may require will be covered under separate agreements, if any, or applicable provisions of NYISO’s or Connecting Transmission Owner’s tariffs. The Interconnection Customer will be responsible for separately making all necessary arrangements (including scheduling) for delivery of electricity in accordance with the applicable provisions of the ISO OATT and Connecting Transmission Owner’s tariff. The execution of this Agreement does not constitute a request for, nor agreement to, provide Energy, any Ancillary Services or Installed Capacity under the NYISO Services Tariff or any Connecting Transmission Owner’s tariff. If Interconnection Customer wishes to supply or purchase Energy, Installed Capacity or Ancillary Services, then Interconnection Customer will make application to do so in accordance with the NYISO Services Tariff or Connecting Transmission Owner’s tariff.

  • Interconnection Customer Compensation If the CAISO requests or directs the Interconnection Customer to provide a service pursuant to Articles 9.6.3 (Payment for Reactive Power) or 13.5.1 of this LGIA, the CAISO shall compensate the Interconnection Customer in accordance with the CAISO Tariff.

  • Scheduling Vacations Vacations are to be scheduled in advance and taken at such reasonable times as approved by the employee's department with particular regard to the needs of the Employer, seniority of employee, and, insofar as practicable, with regard to the wishes of the employee. No vacation shall be assigned by the Employer or deducted from the employee's account as disciplinary action.
