CERTIFICATES AND LICENCES. (1) Certificates of airworthiness, certificates of competency and licences issued or rendered valid by one Contracting Party and still in force shall be recognized as valid by the other Contracting Party for the purpose of operating the agreed services on the specified routes, provided that the requirements under which such certificates and licences were issued or rendered valid are equal to or above the minimum standards established under the Chicago Convention.
(2) Each Contracting Party reserves the right, however, of refusing to recognize for the purpose of flights above or landing within its own area, certificates of competency and licences granted by the other Contracting Party, pursuant to Article 32 (b) of the Chicago Convention.

Certificates of airworthiness, certificates of competency and licences issued or rendered valid in accordance with the laws and regulations of one Contracting Party, including in the case of the Government of the Republic of Malta, European Union laws and regulations, and unexpired, shall be recognized as valid by the other Contracting Party for the purpose of operating services provided for in this Agreement, provided that the requirements under which such certificates or licences were issued or rendered valid are equal to or above the minimum standards which are or may be established pursuant to the Convention.

2. If the certificates or licences referred to in paragraph 1 of this article were issued or rendered valid according to requirements different from the standards established under the Convention, and if such difference has been filed with the International Civil Aviation Organization, the aeronautical authorities of the other Contracting Party may request consultations in accordance with Article 17 of this Agreement with a view to satisfying themselves that the requirements in question are acceptable to them. Failure to reach a satisfactory agreement in matters regarding flight safety will constitute grounds for the application of Article 5 of this Agreement.

(2) Each Contracting Party reserves its rights, however, not to recognise as valid, for the purpose of flights in its own territory, certificates of competency and licences granted to its own nationals or rendered valid for them by the other Contracting Party or by any other State.
CERTIFICATES AND LICENCES. 17.1 Employees in the following classifications are required to have the listed certificates and/or licences: Instrument/Electrician Technician Industrial Electrician Certificate of Qualification recognized by the Ontario College of Trades (or successor) or Electrician – Construction & Maintenance Certificate of Qualification recognized by the Ontario College of Trades (or successor) and Instrumentation and Control Technician Certificate and either IMT or G1 or G2 Certificate Instrument Technician Instrumentation and Control Technician Certificate of Qualification recognized by the Ontario College of Trades (or successor) Industrial Electrician Industrial Electrician Certificate of Qualification recognized by the Ontario College of Trades (or successor) or Electrician – Construction & Maintenance Certificate of Qualification recognized by the Ontario College of Trades (or successor) Industrial Mechanic Millwright Industrial Mechanic Millwright Certificate of Qualification recognized by the Ontario College of Trades (or successor) and either IMT or G1 or G2 Certificate Maintenance Technician Mechanical Certificate (i.e., Industrial Mechanic Certificate, Industrial Millwright Certificate, Machinist Certificate, Pipefitter Certificate, or Welder Certificate) and/or Instrument Technician Certificate, and/or Electrician Certificate and either IMT or G1 or G2 Certificate Operating Engineer - TSSA (2nd Class) Second Class or higher Operating Engineer Certificate Operating Engineer - TSSA (3rd Class) Third Class or higher Operating Engineer Certificate Classifications Required Certificates and/or Licences Operating Engineer – TSSA (4th Class) Laboratory Technician Fourth Class or higher Operating Engineer Certificate Post-secondary diploma or higher in Chemical Engineering Technology, Quality Engineering Technology, or similar Manufacturing or Process Technology Material Handler Either a Class A-Z Driver’s Licence or, when requested by the Company to do so, successful completion of the Company’s Truck-Handling Training Program Certificate.

Each Contracting Party reserves the right, however, to refuse to recognise, for the purpose of flights above its own territory, certificates of competency and licences granted to its own nationals by the other Contracting Party.

Where Production Technicians are either required to hold particular certificates and/or licences to perform their duties, or management (at their sole discretion), determine it is in the best interest of the Athena Gas Plant for an individual to hold particular licences or certificates, the Company will (upon the production of relevant receipts), reimburse all reasonable costs associated with obtaining and/or maintaining these certificates or licences.
