Certificates of Occupancy and Certificates of Completion. (a) Upon Completion of Construction of the Project or any Phase of the Project, the Redeveloper shall diligently apply to the appropriate City construction code official for a Certificate of Occupancy. (b) Following Completion of the Project or any Phase of the Project and receipt of a Completion Notice from Redeveloper, the City agrees to issue a Certificate of Completion. The Certificate of Completion shall constitute a recordable, conclusive determination of the satisfaction and termination of the covenants and restrictions with respect to the Project, in this Redevelopment Agreement and the Redevelopment Plan. Within thirty (30) days after receipt of the Completion Notice, the City shall provide Redeveloper with the Certificate of Completion or a written statement setting forth in detail the reasons why it believes that Redeveloper has failed to Complete the Project, in accordance with the provisions of this Agreement or is otherwise in default hereunder. Upon issuance and recordation of the Certificate of Completion, the Declaration of Covenants and Restrictions for the Project shall be released to the extent set forth in the Declaration.

Upon the issuance of the Certificate of Completion, the conditions determined to exist at the time the Property underlying such East Side Phase was determined to be an area in need of redevelopment shall be deemed to no longer exist. The land and improvements comprising such East Side Phase shall no longer be subject to (i) any covenant, pursuant to this Agreement, running with that portion of the land covered by the Certificate of Completion, including without limitation the Declaration of Restrictions (except for those that expressly survive pursuant to the terms of the Declaration of Restrictions), and (ii) eminent domain for purposes of redevelopment as a result of those determinations, if applicable. (d) Upon Completion of the West Side Phase, including Completion of the Lake Drive Phase, the Borough, in its reasonable discretion, shall promptly issue Redeveloper a Certificate of Completion for the West Side Phase. (b) Following Completion of the Project, the Town agrees to issue a Certificate of Completion. The Certificate of Completion shall constitute a recordable, conclusive determination of the satisfaction and termination of the agreements and covenants with respect to the Project in this Redevelopment Agreement and the Redevelopment Plan. Within Twenty (20) days after receipt of the Completion Notice, the Town shall provide Redeveloper with the Certificate of Completion or a written statement setting forth the reasons why it believes that Redeveloper has failed to Complete the Project in accordance with the provisions of this Agreement or is otherwise in default hereunder. Upon issuance of a Certificate of Completion, the conditions determined to exist at the time the Property was determined to be an area in need of redevelopment shall be deemed to no longer exist, and, to the extent applicable, the Property shall no longer be subject to eminent domain as a result of those determinations.

  • Occupancy and Use The premises shall be used solely as a dwelling for Tenants(s) and for no others and no others may spend amounts of time on the premises so as to disturb other Tenants. Tenant agrees not to use or permit the use of the premises for unlawful or immoral purposes. Tenant agrees to keep the premises clean, sanitary and in good order, and agrees not to hamper, disturb or interfere with other tenants in the building or apartment, not to create or suffer any nuisances in the premises affecting the rights of others, and agrees to comply with all laws, ordinances, rules, regulations and directions of governmental authorities. Upon termination of this Lease, Tenant agrees to surrender possession in as good condition and repair as when received, ordinary wear and tear accepted.
