Common use of Change of Starting Time Clause in Contracts

Change of Starting Time. (a) Notice of change in starting time shall be given as much in advance as possible, but not later than sixteen (16) hours prior to the start of his/her next scheduled shift. (b) When an employee is on duty, the Company will be deemed to have given notice when such notice is posted and the Company has made every reasonable effort to reach the employee. If the employee is off duty, the Company shall notify the employee directly. If such notice is not given pursuant to Article 27.3 (a), the employee shall report for work as re-scheduled. He/she shall be paid for all hours originally scheduled plus any additional hours worked at his/her basic pay. Such payment shall be in addition to any overtime incurred by the employee for the tour of duty in question. Notwithstanding the foregoing, such notice shall not apply under any of the following circumstances: (i) emergencies arising as a result of accidents or urgent and essential work to be done to machinery, equipment or plant (ii) in the case of sick leave replacement.
