Changes by Mutual Agreement. Any Step or Steps in the grievance procedure, as well as time limits prescribed at each Step of the grievance procedure, may be waived by mutual written agreement of the parties. Meeting dates will be agreed upon by all parties. If the WBNG fails to exhaust remedies under this procedure or to abide by the time limits with respect to each Step, the grievance shall be deemed abandoned. If any responses are not received within the prescribed time limits, the WBNG may move the grievance to the next Step of the grievance procedure.
Changes by Mutual Agreement. The Department will give the MCO forty-five (45) calendar days notice of any such change that reflects service increases, and the MCO may elect to accept or reject the service increases for the remainder of the term of this contract. The Department will give the MCO sixty (60) calendar days notice of any such change that reflects service decreases, with the right of the MCO to dispute the amount of the decrease within that sixty (60) calendar day period. The MCO has the right to accept or reject service decreases for the remainder of the term of this contract.
