Classification and Reclassification Requirement. Position classification and reclassification shall be subject to mutual written agreement between the District and CSEA, and any dispute shall be subject to the grievance procedure. Reclassification is defined as: Movement of a position from one classification to another as a result of the change of the duties being performed by the incumbent. 8.2.1. The District will either remove the additional duties or will forward the recommendation to the Governing Board for final approval within thirty (30) calendar days. Should the District decide to remove the additional duties from the incumbent, the District shall meet with the bargaining unit member and CSEA Chapter 707 to discuss the impact and effects of such decision. If at the end of the thirty (30) day period no action has been taken, the bargaining unit member will receive out-of-class pay retroactive to the date of notification of the committee's final determination, until duties affecting classification are removed. See Article 7.8. - Working Out-of-Classification. 8.2.2. When a position is reclassified, the incumbent will be retained in the position. 8.2.3. When a position is reclassified, the incumbent shall be placed on the step of the new classification which is at least five (5) percent higher than the monthly salary of the bargaining unit member’s classification and step at the time of the reclassification. 8.2.4. If the reclassified position is vacant, it will be filled by the competitive process approved by the District.

For purposes of determining compliance at any time with Sections 10.01 and 10.04, in the event that any Lien or Indebtedness meets the criteria of more than one of the categories of transactions or items permitted pursuant to any clause of such Sections 10.01 and 10.04, Lead Borrower, in its sole discretion, may, from time to time, classify or reclassify such transaction or item (or portion thereof) and will only be required to include the amount and type of such transaction (or portion thereof) in any one category. Reclassifications of any utilization of the Incremental Amount shall occur automatically to the extent set forth in the definition thereof.
