Common Name. Developer has established a common name for the Project “Union Village”. Developer reserves the right to change or modify this common name or portions thereof and shall disclose such proposed name(s) to the City, by written letter to the Community Development Director. ▇▇▇▇▇▇▇▇▇ agrees that City will not be acting unreasonably by denying a common name(s) that suggests the Development or portions thereof are located somewhere other than in the City. The City acknowledges that Developer will devote substantial resources to promote such common name(s) and protect its value as a unique intellectual property right which may include filing state and federal registrations for such name. The Parties therefore agree that Developer shall have the exclusive right to own, control and license the name(s). The City shall have no obligation to police the use, wrongful or otherwise, of the name(s) by third parties.
