Conditions of Warranty. To the extent that any failure by Contractor to meet the foregoing warranties is the result of (a) Owner’s failure to receive, handle, store, maintain, or install the Equipment furnished in a reasonable manner or in accordance with any reasonable Contractor requirements conveyed to Owner, (b) Owner’s failure to operate the Equipment within its rating or operated and maintained in a reasonable manner consistent with Contractor’s or Equipment vendors’ instructions, (c) Owner subjecting the Equipment to abuse or misuse, or (d) normal wear and tear or corrosion inherent in the operation of the Facility, then, to that extent, Contractor shall be excused for said failure.
Conditions of Warranty. The warranties and remedies set forth herein are conditioned upon the transformers being received, handled, stored, installed, operated and maintained in a normal and proper manner in accordance with any PPI recommendations and standard industry practices and not having been subjected to accident, alteration, abuse or misuse. Shipment of the defective transformer must be made to PPI or some pre-designated location as authorized by PPI, freight prepaid. Also, the defective transformer must be properly strapped to a shipping pallet or enclosed in a crate. All parts of the transformer must be at least two (2) inches inside the edge of the pallet or crate. Should a transformer fail within the warranty period, the purchaser must insure that the transformer is protected from further damage or deterioration while being stored or otherwise awaiting shipment back to PPI. Should there be any defects in workmanship and/or materials within the warranty period and provided PPI has received a written notification of such failure within one (1) month of its occurrence, PPI shall correct such non-conformity at its F.O.B. factory of the defective part or parts. Conditions of Warranty. Barkclad’s liability shall be subject to the following terms and conditions: a. The product must be stored according to the manufacturer’s instructions at all times between purchase and installation.
b. The product must be installed according to Barkclad’s installation instructions and all building codes adopted by federal, state, or local governments or government agencies and applicable to the installation. Repaint may be required if paint coverage is broken. The polyurethane composition can oxidize if the paint layer is broken and the uncoated polymer is subjected to weather. Paint applied that is not recommended by Barkclad will void the warranty. Failure to install the product per Barkclad’s published instructions voids the Warranty. This limited warranty shall not cover any labor or charges related to labor.

The warranty set forth herein shall be exclusive of (a) normal wear and tear, (b) normal degradation of the Work or the Gathering System, (c) misuse of the Work or the Gathering System by OWNER or negligence in its operation or maintenance, and (d) operation or maintenance of the Work or the Gathering System not in accordance with the written requirements and recommendations of equipment vendors or suppliers and CONTRACTOR.

i. The Goods have not been properly maintained by the Buyer;

iv. The Goods continue to be used after any fault or defect would reasonably have become known to the Buyer;
v. The defect or fault occurred from reasonable wear and tear;
vi. The defect or fault occurred as a result of circumstances beyond the control of either the Buyer or the Seller;
vii. Maintenance or alteration is made to the Goods by anyone other than the Seller; or
viii. The Seller accepts no responsibility for loss or damage to the Buyer, financial or otherwise, arising from a delay in the time taken for the Seller to replace or repair any Goods covered by the warranty.
Conditions of Warranty. Defective parts must be returned to Canon or a Service Provider with all necessary documentation and will become the property of Canon.
Conditions of Warranty. (a) The Buyer shall exercise the care of a prudent shipowner in keeping the Vessel in good condition, working order and repairs, and shall use the Vessel, its machinery and equipment only for the purpose intended and as described in this Contract during the Warranty Period.
(b) The Buyer shall follow the recommendations contained in operating and maintenance manuals (in English language) provided by the Builder prior to delivery of the Vessel. In the event that the Buyer or its employees or agents shall fail to operate the Vessel, its machinery or equipment, in accordance with the conditions specified herein, the Seller and the Builder shall be entitled to withdraw the Warranty as to the part or parts of the Vessel affected by such failure upon giving written notice to this effect to the Buyer, accompanied by substantiation of such claimed failure.
Conditions of Warranty. This warranty is valid only if the following conditions are met:
a. The Product has been supplied directly by e2v or via a distributor, representative or other selling medium authorised by e2v.
b. The Product has been operated within its specification and in accordance with e2v instructions.
c. The Product has not been subjected to any accident, abuse, alteration, misuse or neglect in storage, transportation, handling or use.
d. The return procedure specified in Paragraph 3 below is followed.
e. The decision of e2v on the cause of failure and on the value and form of any applicable allowances is accepted by the Purchaser.
f. Right of access to equipment for the purpose of checking operating conditions is granted to any representative of e2v where e2v may so require.
g. e2v is notified within 30 days of the Product failure.
h. The Product is withdrawn from service as soon as possible after the alleged failure has occurred.
