Common use of Conducting the Works Clause in Contracts

Conducting the Works. The AFP warrants that all activities relating to the Works will be carried out in accordance with the requirements and standards of all Relevant Authorities including as applicable to the building, construction and fit-out of the Facilities. The Works must be performed during, and completed by the end of, the Works Period The building works must commence within 6 months of receipt of a successful Outcome Letter by the AFP. The AFP must complete the Project within 12 months of the Funding Agreement being executed. If either of these timeframes are not met, it is a breach of the Funding Agreement. The AFP should not enter into any contracts with any third parties prior to the department executing the Funding Agreement, and if they do so they understand it is at their own risk. The AFP must conduct a transparent and competitive tendering process for procuring all goods and services in connection with the Works. This includes ensuring that formal contract documents are entered into with the relevant suppliers. The AFP will be required to engage a project manager for the purposes of overseeing the conduct of the Works who is reasonably satisfactory to the department. To be clear, the department is not approving the project manager.
