Common use of Continuation of Seniority Clause in Contracts

Continuation of Seniority. Any employee who has been or in the future is promoted from this unit to a non-bargaining position with the City shall retain their seniority and continue to accumulate seniority while they remain on such job for a period of six (6) months. If such employee is removed from their non-bargaining position for any reason considered valid under this Agreement (other than discharge), such employee shall be allowed to return to their previous position so long as they are still within the six (6) month timeframe.

Continuation of Seniority. Any employee who has been or in the future is promoted from this what is now the bargaining unit to a supervisory or non-bargaining union position with the City shall retain their seniority and continue to accumulate seniority while they remain he or she remains on such job for a period of six one (61) monthsyear. After such one (1) year period, all bargaining unit seniority rights shall be terminated. If such employee is removed from their his/her management or non-bargaining union position with the City for any reason other than discharge for a reason considered valid under this Agreement (other than discharge)Agreement, such employee he/she shall be allowed to return to their previous any vacant bargaining unit position so long as they are still within the six (6) month timeframefor which he/she is qualified.
