Continuing Sessional Appointments. (a) Bargaining unit employees may be appointed a continuing appointment for a maximum of nine (9) credits to teach the same course, over a period of no more than three (3) contract years (Fall/Winter/Summer sessions). Each instructor may teach a maximum of 3.0 courses per year, with no more than 2.0 courses to be taught in any given session (Fall/Winter, September 1 – April 30, or Spring/Summer, May 1 – August 31). (b) Continuing appointments will be made in accordance with Article 5.07. (c) Continuing appointments may be terminated without fault or cause and these members would receive a cancellation stipend of 15% of the course stipend regardless of the number of sessions remaining. As an alternative, by mutual agreement between the member and Chair/▇▇▇▇, a member may be appointed to another course for which no member holds a senior RFR. (d) It is understood that given the ongoing nature of these positions, the Chair will meet with the member annually to conduct a performance review. This process is intended to recognize a member’s achievement and identify areas of development. It is also an opportunity for the Chair to provide formative support and mentoring. A record of this discussion will be retained in the member’s personnel file. (e) If concerns are raised about a member’s continued competence in teaching a course the chair or delegate may initiate an evaluation. If the member’s performance is subsequently evaluated by the department as “less than fully competent” according to the same procedures outlined in 5.08.04., the Chair shall meet with the member with the objective of effecting improvement in the member’s performance. A second evaluation of the member as “less than fully competent” will result in the member losing her or his continuing appointment for the position in question. (f) Continuing sessional appointments will be posted, as per Article 5.05, for the following academic year no later than March 1 of the previous year. (g) Instructors in continuing sessional appointments are eligible to apply for and earn RFR as per article 5.08.

  • Initial Appointment Upon entering the classified service, an Employee shall receive compensation at the minimum of the salary range of the classified position for which hired. When economic conditions, unusual employment conditions or exceptional qualifications of a candidate for employment indicate that a higher rate would be in the City's best interest, the Department Head with the approval of the Human Resources Manager may authorize hiring at a rate above the minimum for the classified position for which the Employee is being hired, but in all cases, the rate is not to exceed the maximum for the job classification.

  • Excluded Appointments With respect to the Excluded Appointments, (a) nothing in this Agreement shall give the Purchasers the right to control or defend any Proceeding to which any Seller or any of its Affiliates is a party to the extent such Proceedings have resulted in such Appointment being classified as an Excluded Appointment, and, except as may otherwise be agreed between the parties hereto, the Sellers or their Affiliates shall be responsible for the control, defense and/or settlement any such Proceeding and (b) the Sellers or their Affiliates shall be responsible for the control, defense and/or settlement of any matters that have resulted in such Appointment being treated as an Excluded Appointment because the Seller Representative reasonably determines that such appointment is required to be excluded pursuant to applicable Law. Subject to Section 8.2, the Purchasers shall use reasonable best efforts to take any Specified Actions reasonably requested by the Sellers in connection with the Sellers’ defense of such Proceedings or the settlement thereof; provided that the Sellers shall promptly reimburse the Purchasers for any reasonable, documented out-of-pocket costs and expenses incurred by the Purchasers in connection with taking any such actions.

  • Medical Appointments Medical appointments may be charged to sick leave, provided the minimum time charged is not less than one-half (1/2) hour. Each absence shall be reported separately and authorized in advance by the employee's immediate supervisor.
