Contract Documents; Priority. The term “Contract Documents” includes the following, each and all of which are a part thereof and have the same force and effect as if spread at length herein. The following documents are attached and incorporated into this Agreement by reference. In resolving inconsistencies among two or more of the Contract Documents, precedence will be given in the same order as enumerated here. Additional details and more stringent requirements contained in a lower priority document will control unless the requirements of the lower priority document present an actual conflict with the requirements of the higher level document (i.e., it is not possible to comply with both requirements). Unless specifically stated, lower priority documents affected by Addenda shall not take priority through the Addenda. 1. Change Orders (by date);
Contract Documents; Priority. The Contract Documents consist of this Agreement and all Attachments hereto; the Tippecanoe County Request for Proposals: Tippecanoe County Broadband (RFP) dated April 16, 2022; the ARPA Subrecipient Agreement as reflected in this Agreement and Attachments/Exhibits; and the Provider’s Proposal in response to the RFP dated June 30, 2022. Provider agrees to the terms of ARPA Subrecipient requirements as both as reflected in this Agreement, and in Attachment D. The Contract Documents form the Contract.   • Contract Documents This Contract consists of these Terms and Conditions and the documents ("Exhibits") listed below in descending order of precedence. A conflict in these documents shall be resolved in the priority listed below with these Terms and Conditions taking precedence over all other documents.   • THE CONTRACT DOCUMENTS The Contract Documents consist of the State-Contractor Agreement, the Conditions of the Contract (General, Supplementary and other Conditions), the Drawings, the Specifications, and all Addenda issued prior to bid opening and any Change Orders after execution of the Contract.
