Covered Software. Windward will provide Services for the most current release of the Software. Once a release has been made generally available, Licensee should convert to the latest release in order to insure uninterrupted service and continued support.
Covered Software. The support plan covers only standard software deployed with your OS and/or your control panel, and limited support of custom applications as described in section 4b of this agreement. EndLayer is not responsible for any third party add-ons or additional software you may have added to your service. EndLayer shared and dedicated hosting environments are guaranteed to pass a server-level PCI compliance scan by an approved vendor - provided that credit card information is not stored in the local database . Clients must utilize a third-party merchant API or plugin to process credit cards on the remote gateway. Enter transactions with third-party providers on your own responsibility and at your own risk. EndLayer does not assume responsibility for contracts between our clients and third-party vendors in any way, for any transaction. We do not serve as the trustee, fiduciary, agent or representative in any of these agreements. Some of EndLayer’s products are offered under license through outside vendors and these products are covered under any applicable license agreement with the third party. Third-party offers that include discounts or promotions may be subject to additional restrictions by the third-party provider. All agreements and transactions with third-party providers are binding under the provider’s terms and conditions. Be sure to confirm the purchase and use of goods and services with each third-party provider. EndLayer does not guarantee the quality or availability of any goods, services or information provided through a third party. Enter into all transactions with these providers at your own risk. EndLayer reserves the right to exclude any third party software from management. Third party software installed by EndLayer is not automatically included in the support plan. The inclusion of third party software in the support package which comes included with the SPC or SPM services will be evaluated on a case by case basis.
Covered Software. Customer agrees to purchase, and Niku agrees to furnish, software maintenance services for the Software, as defined in the Software License and Services Agreement between the parties, including the associated user documentation (all such computer software programs and associated user documentation shall be referred to herein as the "Software"), in accordance with the terms and conditions of this Agreement.

Covered Software a. Licensee agrees to purchase, and Niku agrees to furnish, software maintenance services (the "Support Services") in support of Licensee's use of software licensed by Niku to Licensee under the terms and conditions of the attached Software License Agreement (the "Agreement"), subject to these Standard Software Support Terms and Conditions (the "Support Terms"). The software covered by this is specified in Exhibit A to the Agreement (the "Software"). All corrections, updates, improvements, modifications and new versions of Software furnished to Licensee (the "Updates") will be considered Software within the meaning of the Agreement, and Licensee's use of the Updates will be governed thereby.
b. The terms of the Agreement governing confidential information, Software warranties and disclaimers, indemnification against intellectual property claims, limitations of liability, notice, governing law, independent contractor status, assignment, waiver, severability, export control, force majeure, and integration of terms are incorporated herein by reference and will govern the Support Terms. Any capitalized terms which are not separately defined in these Support Terms, will have the same meaning as specified in the Agreement.

Covered Software. ▇▇▇▇▇▇▇ will provide Services for the most current release of the Software and the immediately preceding release. Once a release has been made generally available, Licensee should convert to the latest release in order to insure uninterrupted service and continued support. ▇▇▇▇▇▇▇ may determine that a reported item is not a malfunction of the Software, or ▇▇▇▇▇▇▇ may release the correction as part of the next scheduled release.
Covered Software. A. This Agreement covers the following software components at the site indicated in Exhibit A, Section I:
1. AccesstoMemory (AtoM)
i. as made available for public download at ▇▇▇▇://▇▇▇▇▇▇▇▇▇▇▇▇▇▇.▇▇▇.
ii. for the features and functionality documented in the enduser manual for the most current public release.
B. The Covered Software may be installed directly on the hardware located at the Covered Site indicated in Exhibit A, Section I, or on virtual machines at the same Covered Site using the Client’s own hardware and server virtualization platform. A virtual machine is an isolated software container that can run its own operating systems and applications as if it were a physical computer. A virtual machine behaves exactly like a physical computer and contains it own virtual (i.e., softwarebased) CPU, RAM hard disk and network interface card (NIC). Each virtual machine is assigned its own Internet Protocol (IP) address.
C. Artefactual is responsible solely for supporting the Covered Software installed on the servers or virtual machines allocated by the Client to run the Covered Software. The Client is responsible for providing Artefactual with remote, administratorlevel access to the servers or virtual machines which are running the Covered Software.
D. Artefactual is not responsible for the Client's server or virtual machine resource allocation, data backup, security, or network availability and response time except where those may be affected by the operation of the Covered Software within the Client's servers or virtual machines.
