Crossing Guards. Crossing Guards are governed by a Supplemental Agreement to this Memorandum of Understanding. 24 Educational Reimbursement The City will contribute Eight Thousand Dollars for each year of this Memorandum of Understanding into a fund to provide reimbursement for employees' receipted costs for tuition, fees and books incurred by attending educational programs/classes which are directly related to the present or known future needs of the City. Reimbursement will be at One Hundred percent of such receipted costs, to a maximum of Two Thousand Dollars per employee per fiscal year. In order to be reimbursed for such costs, the employee shall submit the request for reimbursement prior to beginning the program/class to the employee's Department Head for approval by the City Manager, and the employee must attain a passing grade of "C" or better, or a "pass" in a pass/fail program. For programs where a passing grade is not provided, presentation of a certificate of completion will be required. Unused funds will not be carried over into the next fiscal year. 25 Savings Clause If any provision of this Memorandum of Understanding should be found to be invalid, unlawful or unenforceable by reason of any existing or subsequently enacted legislation or voter initiative or by judicial authority, all other provisions of this Memorandum of Understanding shall remain in full force and effect for the duration of this Memorandum of Understanding. In the event of invalidation of any provision, the City and the Union agree to meet within thirty days for the purpose of meeting and conferring with respect to such invalidation.
