Defect Resolution i. The Contractor must correct system defects, which are malfunctions or functional deviations from approved system design. The Contractor must take corrective action and ensure that the system performs as designed.
ii. The Contractor must consider the performance standards (data files, systems and reporting) described in the contract, scopes of work, and RFP documentation for timely completion of system defects.
iii. The Contractor must fix all system defects unless the Contractor is not authorized to fix the defect. All system defect repairs must be fully and successfully tested before migration to production. For implementation of system defect repairs the Contractor must work with the State to coordinate the release of the repairs.
iv. Upon correction of the problem, the Contractor must notify the State that the problem is resolved and submit a written report of the defect analysis and resolution implemented.
Defect Resolution. The Contractor’s development team shall determine the root cause, implement the changes needed to fix the defect, and document the details of the resolution in an agreed upon defect management software between the Contractor and State before the first code Release, and shall include suggestions on how to verify the defect is fixed.
Defect Resolution. If there is a defect in the Software, AppDynamics will, at its sole option, repair that defect in the version of the Software that End User is currently using or instruct End User to install a newer version of the Software with that defect repaired. AppDynamics reserves the right to provide End User with a workaround in lieu of fixing a defect should it in its sole judgment determine that it is more effective to do so.
Defect Resolution. Should we determine that an Offering has a defect, we will, at our sole option, repair the defect in the version of the Offering that you are then currently using or instruct you to install a newer version of the Offering with that defect repaired. We reserve the right to provide you with a workaround in lieu of fixing a defect should we in our sole judgment determine that it is more effective to do so.

Should NetFlow Logic in its sole judgment determine that there is a defect in the Software, it will, at its sole option, repair that defect in the version of the software that you are currently using or instruct you to install a newer version of the Software with that defect repaired. Should 3D Systems in its sole judgment determine that there is a defect in the Software, it will, at its sole option, repair that defect in the version of the Software that you are currently using or instruct you to install a newer version of the Software with that defect repaired. 3D Systems reserves the right to provide you with a workaround in lieu of fixing a defect. Should you report a purported defect in the Software to 3D Systems, 3D Systems may ask you to provide the following information: (i) a general description of the operating environment, (ii) a list of all hardware components, operating systems and networks, (iii) a reproducible test case, and (iv) any log files, trace and systems files. Your failure to provide this information may prevent 3D Systems from identifying and fixing that purported defect.

Should Splunk in its sole judgment determine that there is a defect in the Software, it will, at its sole option, repair that defect in the version of the Software that you are currently using or instruct you to install a newer version of the Software with that defect repaired. Splunk reserves the right to provide you with a workaround in lieu of fixing a defect should it in its sole judgment determine that it is more effective to do so.

Should Outcold Solutions in its sole judgment determine that there is a defect in the Licensed Software, it will, at its sole option, repair that defect in the version of the Software that Customer is currently using or instruct Customer to install a newer version of the Software with that defect repaired. Outcold Solutions reserves the right to provide Customer with a workaround in lieu of fixing a defect should it in its sole judgment determine that it is more effective to do so.
Defect Resolution. Arbre Technologies shall use commercially reasonable efforts to respond to customer reports of problems with the Arbre Technologies Products and Services and will attempt to provide status updates and resolve issues based on their Severity Level in the time frames set forth in the System Resolutions Timeline table in Section 5.2.
