Common use of Definition of Property Clause in Contracts

Definition of Property. As used herein, the term Property shall include: (a) the Land, (b) all rights, privileges, easements, tenements, hereditaments, rights of way and appurtenances which belong to or appertain to the Land and are owned by County, including all development rights, air rights, water, water rights and water stock, if any, relating to the Land, and (c) all improvements, buildings, structures, fixtures, parking structures and facilities now existing or placed, constructed or installed upon the Property prior to the Close of Escrow. Rights to all minerals, oil, gas and other hydrocarbon substances on and under the Land, were excluded from the EDC by the United States Air Force, and therefore are excluded from this transaction.
