Definition of Sole Source Sample Clauses
The Definition of Sole Source clause establishes the criteria under which a product or service is considered available from only one supplier. It typically outlines the specific conditions that must be met for a procurement to be classified as sole source, such as the uniqueness of the supplier’s offering or the absence of viable alternatives in the market. This clause is essential for justifying non-competitive procurement processes, ensuring that sole source designations are used appropriately and transparently to prevent unnecessary restrictions on competition.
Definition of Sole Source. As used in this Article 3.2.16, “Sole Source” means a Trade Contractor or Supplier or Subcontractor specified by name in a Bulletin as the exclusive source from which conforming goods or services may be obtained. Designation of goods or services by reference to a named source accompanied by the qualification “or equal” or similar language is not a designation of a Sole Source as that term is defined herein.
