Developer’s Minimum Load Fee. With respect to the Developer’s Minimum Load, the Developer shall be obligated to pay its pro rata portion of the Total Project Costs based on the relation that the Developer’s Minimum Load bears to the total capacity of the Substation in MVA in accordance with the following formula (the “Developer’s Minimum Load Fee”): = ( ) + ′ 2 = ( $22,869,000) + $1,358,000 = $6,440,000 Where:

Developer’s Minimum Load Fee. With respect to the Developer’s Minimum Load, the Developer shall be obligated to pay its portion of the Substation Capacity Costs based on the Developer’s Minimum Load on a per MVA basis and the Total Distribution Facilities Costs in accordance with the following formula (the “Developer’s Minimum Load Fee”): Developer’s Minimum Load Fee = SC + TD Developer’s Minimum Load Fee = (DML x $612,016) + TD Developer’s Minimum Load Fee = (11.231 x $612,016) + $7,250,000 Developer’s Minimum Load Fee = $14,123,552 Where: DML = The Developer’s Minimum Load as of the date of this Agreement. SC = The sum of the Substation Capacity Costs TD = The Total Distribution Facilities Costs. The actual Total Distribution Facilities Costs shall be tracked by the City, and the Developer shall be issued a refund for any amounts not spent or invoiced for any amount spent in excess of the estimated Total Distribution Facilities Costs collected (the “True-up”), within thirty (30) days of Project completion.

  • License Fee The Licensee to shall make payment of the License Fee to Licensor on the date of this Agreement. All rights granted to Licensee by Producer in the Beat are conditional upon Licensee’s timely payment of the License Fee.
