Emergency Closures. A. The University’s inability to make a Room available to me for any reason beyond the University’s control including, but not limited to, natural disaster, fire, flood, earthquake, condemnation, pandemic, quarantine, utility malfunction, infestation, or other emergency or force majeure event shall not constitute a breach of this Agreement by the University. In such circumstances, the University shall have no liability to me in any way for injuries, reimbursement, damages, inconvenience, annoyance or compensation of any kind. The University may attempt to find, but cannot guarantee, an alternative space for me. If the unavailability of my Room or an alternative space persists for more than 72 hours, I may terminate this Agreement and Check out during said unavailability without penalty provided that I shall be responsible for all financial obligations incurred up to the date of such termination. The University agrees to provide me with a pro rata refund, calculated from the date of such termination to the end of the Agreement Period, of any prepaid housing and dining payment made to the University, and to return my Deposit pursuant to this Agreement. Upon resumption of standard operations, Agreement Termination requirements and charges will apply as described in Section XIV. B. If the University closes all dining facilities for emergency reasons or due to the emergency closure of the University, HFS agrees to provide a pro rata refund of my Dining Account balance based on the number of days in which all dining facilities covered by the Dining Account were unavailable for one or more meal periods and the number of days in this Agreement excluding all days on which the dining facilities were scheduled for closure prior to the emergency.

In such circumstances, the College shall have no liability to Resident in any way for injuries, reimbursement, damages, inconvenience, annoyance or compensation of any kind. B. The College may attempt to find, but cannot guarantee, an alternative Unit for the Resident. If the College deems Resident’s Unit or an alternative space unavailable for more than 72 hours, the College may offer the Resident the opportunity to terminate this Agreement and Check out during said unavailability without penalty provided that the Resident shall be responsible for all financial obligations incurred up to the date of such termination. C. The College will provide a prorated refund, calculated from the date of emergency closure to the end of the Agreement Period, of any prepaid housing and dining payment made to the College. It is the College that determines whether emergency closure under this section is necessary and the timeframes to which it applies. The College will notify the Resident of resumption of standard operations via their @▇▇▇▇▇▇▇▇▇.▇▇▇ email address, at which point Agreement Termination requirements and charges will apply as described in Section 10.

Emergency Closures. When the University is closed due to emergency situations such as a snowstorm or other circumstances, non-exempt employees designated as essential who are required to work, or non-exempt employees who volunteer and are approved to work, shall, at the employee's request, be compensated at the rate of two (2) times the regular rate of pay or receive the regular rate of pay and compensatory time for each hour worked.

In such circumstances, the University shall have no liability to me and my Family in any way for injuries, reimbursement, damages, inconvenience, annoyance, or compensation of any kind. The University may attempt to find, but cannot guarantee, an alternative space for me and my Family. If the unavailability of my Apartment or to an alternative space persists for more than 72 hours, I may terminate this Agreement and Move out during said unavailability without penalty provided that I shall be responsible for all financial obligations incurred up to the date of such termination. The University agrees to provide me with a pro rata refund, calculated from the date of such termination to the end of the Agreement Period, of any prepaid housing payment made to the University and to return my deposit pursuant to this Agreement. Upon resumption of standard operations, Agreement termination requirements and charges will apply as described in Section 16.
Emergency Closures. A. The University shall provide the Union with a list of bargaining unit members deemed essential by November 15 of each year. The determination of which exempt and non-exempt employees are deemed essential shall be made by the University and shall not be subject to the grievance and arbitration procedure herein. B. When the University is closed due to emergency situations such as a snowstorm or other circumstances, exempt employees designated as essential who are required to work, or exempt employees who volunteer and are approved to work, shall receive an hour of compensatory time for each full hour worked.
Emergency Closures. During time of war or national emergency, City shall have the right to enter into an agreement with the United States Government for military or naval use of part or all of the landing area, the publicly-owned air navigation facilities and/or other areas or facilities of the Airport. If any such agreement is executed, the provisions of this Agreement, insofar as they are inconsistent with provisions of the agreement with the Government, will be suspended.
Emergency Closures. In the event that any City office closes due to inclement weather, national crises, or other emergency, affected employees shall receive notification from a supervisor via phone call no later than one (1) hour prior to the start of their shift, if reasonably possible. Employees who cannot work due to an emergency closure shall be paid for the hours that they are scheduled to work up to one (1) day. The employee shall have the choice to use vacation leave, compensatory time, or unpaid personal leave towards any closure lasting longer than one day. Employees whose duties require them to work during an emergency shall be paid for all hours worked, and for the remainder of any shift that may not be completed if sent home early.
Emergency Closures. No bargaining unit member shall be deprived of any wages due to emergency school closures.
