Emergency Needs Clause Samples

The Emergency Needs clause allows for specific actions or exceptions in situations where urgent or unforeseen circumstances arise. Typically, this clause permits parties to deviate from standard procedures or requirements in order to address immediate threats to safety, property, or essential operations. For example, it may allow a contractor to procure materials or services without prior approval if a critical system fails. The core function of this clause is to ensure that necessary and timely responses can be made during emergencies, thereby minimizing harm or disruption and providing flexibility when normal processes would be too slow or impractical.
Emergency Needs. If any Member Agency identifies any emergent, unanticipated, and unfunded need for Project- related services, the Advisory Committee shall be responsible for evaluating the need and voting on a majority basis on how the Parties, jointly, should respond to such need. Nothing in the Agreement shall preclude any Member Agency, independent of the other Parties and the Advisory Committee, from responding to an emergent need in a manner that that government deems appropriate.
Emergency Needs. In the event the Joint Office identifies any emergent and unanticipated need for unbudgeted services consistent with its functions described in Section 8.2, and lacks the funding to provide those services, either Party may request additional funding.

Emergency Needs. If as a result of a McKesson filling or shipping error, Rite Aid has an insufficient quantity of any Rx Product for Warehouse, McKesson agrees to ship (at no additional expense) additional quantities of such Rx Product by expedited next day delivery so that Rite Aid will have sufficient quantities on hand to last until Rite Aid would normally have the product available for store shipments based on the next customary available delivery date. If Rite Aid requests an emergency shipment for Warehouse for any other reason, McKesson agrees to make the shipment, and Rite Aid shall pay any additional freight costs incurred by McKesson in connection therewith.
Emergency Needs. Nothing contained in any of the job descriptions negotiated and agreed to by and between the Union and the Home, shall be construed in any way as prohibiting the Home in an emergency situation from assigning job duties or tasks not referred to in the job description for that particular employee. Nothing contained in this Collective Bargaining Agreement shall prevent the Home from unilaterally implementing any and all changes necessary to insure compliance with the Americans with Disabilities Act.
